Mayor Prats called the regular meeting of the Town Council to order at 7:36 p.m. Council members Jim Ruspi, Josh Pomeroy, Charles Bradsher and Dave Preusch were present. The Clerk, Treasurer and Assistant Clerk were present. Eric and Sheree Wengerand Cub Scout Pack #1323 were also present.The minutes of the Town Council meeting on January 8, 2013 were approved as submitted.
Treasurer’s Report:The Treasurer reviewed the Profit and Loss Report for the month of January 2013. Total income for the month of January was $29,989 with $8,746 coming from Income Tax, $19,021 coming from Real Property Taxes. Major expenses for January 2013 were $1,600 for Consultants, $1,922 for Land Planning, and $2,886 for Waste Collection. The General Net Income for the month of January was 19,788. Looking at the Balance Sheet for the month of January, 2013 the fund balance for the general fund was$816,028; for the CIP account, the balance was $175,147, the Fixed Assets was $684,352. The total fund balance for the Town of Laytonsville for January 2013 was $1,675,528.
Council Member Pomeroy moved to approve the January Treasurer's report subject to audit. Council Member Preusch seconded the motion. Unanimously approved.
Committee Reports:
Planning Commission Chair, Eric Wenger, presented the final draft of the comprehensive plan to the Town Council. Mayor Prats thanked Chair Wenger and the Planning Commission for their work on the comprehensive plan and scheduled a work session for February 19 at 7:30. Members of the Planning Commission were encouraged to attend thework session. Council Member Pomeroy also thanked Chair Wenger and the Planning Commission.
Mayor’s Updates and Reports:
WSSC Update: Mayor Prats stated that water should be available between midsummer and the fall of 2013. Progress is continuing on the pumping station.
Town Hall Cleaning:Mayor Prats stated that The Town Hall was cleaned by a Goshen Mennonite Church youth group on January 19 and they did a very nice job.
Trash/Recycling:Mayor Prats reported that trash and recycling materials were picked up on Tuesday following the Martin Luther King day holiday. There was a bit of confusion but people liked it and the Town will continue doing it.
Elections: There are two council member positions and the position of mayor on the ballot for the election on May 6.
Election Judges:Mayor Prats stated that no one has yet volunteered to be an election judge. He asked council members to encourage residents to sign up.
Town Sign: Mayor Prats reported that the town is working with Stadler Nursery to find a solution as to how to repair the sign because it is on their landscaping property.
Work Session: There will be a work session on February 19 at 7:30 pm to discuss the comprehensive plan.
Open Issues:
Council Member Pomeroy made a motion to move the swale issue from the table. Council Member Preusch seconded the motion. The issue of concern is whether it is the responsibility of the homeowner or of the town to maintain the swales. Mayor Prats stated that there is some erosion occurring in Rolling Ridge due to the swales not being maintained. Council Members Pomeroy and Ruspi felt that it is the homeowner’s responsibility to maintain swales on their property. Discussion followed as to whether the slopes of the swales should be corrected so that residents can mow them safely. Council Member Preusch made a motion to retable the swale issue. Council Member Bradsher seconded the motion.
It was noted by Council Member Pomeroy that invasives across from Rolling Ridge on the south side of Brink Road have grown back. Mayor Prats stated that Pepco should be contacted as to what their maintenance plan is for that area.
New Business:
Planning Commission Chair, Eric Wenger stated that Paul Simonetti accepted the appointment to become a member of the Planning Commission. He has a background in government and private contracting. Council Member Ruspi made the motion to approve the nomination of Paul Simonetti to the Planning Commission. Council Member Pomeroy seconded the motion. Unanimously approved.
It was noted that Council Member Preusch has stepped down from his position on the Planning Commission to become an advisor. Mayor Prats and Chair Wenger thanked him for his work on the Planning Commission.
Mayor Pratsmade a nomination to appoint Mike Seebold to the Board of Appeals. He is a historic architect and has previously done advisory work for the Laytonsville Historic District Commission. Council Member Pomeroy made a motion to approve the nomination of Mike Seebold to the Board of Appeals. Council Member Bradsher seconded the motion. Unanimously approved.
Council:
Council Member Pomeroy reported on various projects that are going on in the area. He stated that the newly renovated Olney library is scheduled to re-open in the spring of 2013. The Gaithersburg library is scheduled to re-open in the fall of 2013.
He also stated that the Woodfield Road expansion project has been on hold.
The Brookville bypass is moving forward.
The rapid transit study for Route 97 is underway.
Council Member Preusch questioned when FIOS would be coming to town.

Trash/Recycling Update
When trash and recycling pick-up occur on Monday holidays, the following day, Tuesday, will be the designated pick-up day. The designated holidays follow the county transfer station schedule and will be as follows for 2013:
For Monday, Jan. 21, Martin Luther King, pick-up will be Jan. 22
For Monday, Feb. 18, President’s Day, pick-up will be Feb. 19
For Monday, May 27, Memorial Day, pick-up will be May 28
For Monday, Sept. 2, Labor Day, pick-up will be Sept. 3
For Monday, Nov. 11, Veterans Day, pick-up will be Nov. 12
Please continue to separate recycling materials.
