Addendum to Publishing Agreement

CASE WESTERN RESERVE UNIVERSITY

ADDENDUM TO PUBLISHING AGREEMENT

BETWEEN

AND

1.This Addendum modifies the Publishing Agreement (“Agreement”) between ______(“Author”) and
______(“Publisher”) for the publication of the following work: ______
______(“Work.”)

2.Notwithstanding any terms in the Agreement to the contrary, and in addition to all rights retained by the Author, licensed to the Author by Publisher in the Agreement and any fair use rights of Author, Author and Publisher agree that Author shall retain the following rights:

a.Author, without limitation, shall have the non-exclusive right to use, distribute, reproduce, create derivative works (including but not limited to update), perform and publicly display the Work in electronic, digital or print form, or any other media hereinafter developed, in connection with Author’s teaching, conference presentations, lectures, other scholarly works, and for all of Author’s academic and professional activities.

b.Following publication by Publisher, Author shall have all non-exclusive rights necessary to make, or to authorize others to make, the final published version of the Article available in digital form over the Internet, including but not limited to a website under the control of Author or Author’s employer or through any digital repository, including but not limited to Case Western Reserve University’s “Digital Case” database.

c.Author retains all non-exclusive rights necessary to grant to Author’s employer the non-exclusive right to use, reproduce, distribute, display, publicly perform and make copies of the Work in electronic, digital or print form, or any other media hereinafter developed, in connection with teaching, digital repositories, conference presentations, lectures, other scholarly works, and all academic and professional activities conducted at Author’s employer.

3.The parties agree that wherever there is any conflict between this Addendum and the Publication Agreement, the provisions of the Addendum will control.

4.This Addendum and Publication Agreement, taken together, constitute the final agreement between Author and Publisher with respect to the publication of the Work and allocation of rights in the Article under copyright. Any modification of, or addition to the terms of this Amendment or to the Publication Agreement must be in writing and signed by both Author and an authorized representative of Publisher in order to be effective.
