The Mayor Cr Stubbs welcomed everyone to the meeting which had been relocated to the Banquet Room Stonnington City Centre Malvern due to the large number of attendees for item 3.

A.Reading Of The Reconciliation Statement And Prayer

Fabienne Thewlis, Manager Governance & Corporate Support, read the following reconciliation statement:

We acknowledge that we are meeting on the traditional land of the Boonwurrung and Wurundjeri people and offer our respects to the elders past and present. We recognise and respect the cultural heritage of this land.

The Council meeting took place in the Malvern Banquet Hall due to the numbers in the gallery attending in relation to Item 3 - Milton Gray Scout Hall - 216 Wattletree Road.

The meeting began with a prayer at 7.03pm.

The Mayor, Cr Stubbs, introduced Councillors and the CEO, Warren Roberts, to the meeting. The CEO introduced Council Officers to the meeting.

Cr Davie declared an Indirect Interest – Close Association in relation to Item 12 - Planning Scheme Amendments C199 & C201 - Interim and Permanent Heritage Protection for 24 Grange Road, Toorak, as she has family living in the vicinity.

Cr Ullin indicated he may have one and if so will declare at the relevant item.

During Council’s previous Ordinary Meeting no set of Questions to Council was received from members of the public.

For tonight’s Ordinary Meeting of Council no set of questions to Council has been received for response.

F.Correspondence – (only if related to council business)

Cr Ullin tabled the following correspondence:

  • Correspondence in relation to Item 3 - Milton Gray Scout Hall - 216 Wattletree Road:

Two emails (17.2 & 2.5.14) noting that community consultation clearly favours retention of the hall, yet the Council Officers’ report states that the community is divided.

An email (4.5.14) from the District Commissioner, Glen Eira Stonnington District Scouts, with an attached plan to reinvigorate 2nd Malvern Scout Group. The email outlines various concerns with the Council Officers’ report, stating that the 2nd Malvern Scout Group is viable and suggesting a shorter term lease to enable it to be re-established.

  • An email (30.4.14) from the applicant for Permit Application 0843/13 – Unit 7, 38 Williams Road, with an attached letter to objectors. The email notes that the proposed art gallery would be of significant community benefit with minimal amenity impacts.
  • An email (1.5.14) from a resident with attached hand-drawn plans proposing measures to ameliorate problems caused by a plane tree.
  • A letter signed by 10 residents of Malvern East objecting to Planning Application 0966/13 - 114-116 Argyll Street, Malvern East, on the grounds of: the distribution of misleading initial plans; and a VCAT ruling on an earlier development in the street.
  • An email (30.4.14) objecting to the C184 Public Acquisition Overlay of five Prahran properties on the grounds of excessive development in the area.

Cr McMorrow tabled the following correspondence:

An email (4.5.14) giving the history of the present situation, noting strong community support for retention of the hall and requesting that the Scout group be permitted to use the hall for a limited period rather than spending ratepayers’ money unnecessarily.

Cr Chandler tabled the following correspondence:

  • A letter (30.4.14) from the President, Chapel Street Precinct, urging Council to increase the budget allocation in relation to the Chapel Street Precinct in the draft Four Year Capital Works Program to accelerate the process of revitalisation.
  • Emails (15 & 16.4.14) from a resident of Toorak suggesting that the rubbish hopper in the Jackson Street car park be replaced by a decomposer which would eliminate the current unsightly littering and health issues. The email also suggests installing such decomposers for the use of restaurants across the city. Cr Chandler asked that the correspondence be referred to the Environment and Sustainability Committee for consideration.
  • An email (29.4.14) from a resident of South Yarra expressing concern about parking in Alexandra Avenue which is blocking traffic.
  • A letter from a resident giving information about methods to control the Indian Myna Bird. Cr Chandler asked that the correspondence be referred to the Environment and Sustainability Committee for consideration.

An email (5.5.14) asking that Council lease the hall to the Scouts on a two-year trial basis and noting that the Encyclopaedia of Melbourne is soon to recognise the nearby Malvern Primary School as the cradle of the worldwide scouting movement in Victoria in 1907.

An email (5.5.14) from a resident of Malvern claiming that information in the Council Officers’ report is misleading.

An email (5.5.14) from the President of the 2nd Malvern Scout Group Parent Committee asking Council to reject the Council Officers’ recommendation and offer the Scout group a five-year lease, subject to providing Council with annual reports of progress.

An email (5.5.14) from a resident of Malvern noting that 80% of residents support retention of the Scout hall and claiming that the Council Officers’ report was biased.

An email (5.5.14) from residents of Malvern in support of retention of the Scout hall on the grounds: that it is a valuable community resource able to be used by a number of community groups; and that there will be no maintenance burden on Council; and suggesting that Council give the Scouts a performance-based short term lease option.

The Mayor, Cr Stubbs, noted that he had been ill on 1 and 2 May, and apologised if he had not yet responded to correspondence sent to him during that time.

G.Questions to Council Officers from Councillors

Cr McMorrow referred to a question he had asked at the previous Council meeting in relation to the area around Tooronga Road and Milton Parade. An East Ward meeting has been held and residents are concerned about traffic management issues, distinct from the issues with the railway crossing. He asked that a collaborative traffic management plan be brought to Council consistent with the context around the pedestrian crossing and the rail crossing.

Cr McMorrow said he had received queries from South Yarra tennis patrons about Thomas Oval, who say it resembles a refuse dump, not an oval. He asked if Council was using Thomas Oval as part of its recreation strategy.

The General Manager City Works, Simon Thomas, took Cr McMorrow’s question about the Tooronga Road rail crossing on notice. He noted that the investigation to date had incorporated traffic and pedestrian studies, and that this was a VicRoads crossing. A report will be brought to Council outlining all that has been done to date, including the VicRoads’ approach to the issue.

Mr Thomas further advised that n relation to Thomas Oval, during each autumn leaf fall, to make collection and disposal processes more effective, Council uses Thomas Oval as temporary storage for autumn leaves for a very short period until all have been collected then it is sent off as green waste.

Cr McMorrow said that the issues he had raised in his first question were not simply about Milton Parade and Tooronga Road, but also the surrounding area and associated traffic issues. His question points to the complexity of the VicRoads issues.

Mr Thomas advised that this is all being taken into account in the report.

Cr Koce noted that the Harold Holt Swim Centre family change area had problems, with considerable pooling of water, high water pressure and excessive water temperature. He noted that Council was retiling the indoor pool and asked that, as part of that upgrade, the concrete in the family change area be ground down to rectify this issue.

Cr Koce also noted that the diving tower at the Harold Holt Swim Centre had been derelict for some time. He said that Harold Holt Swim Centre was an expensive asset and the diving tower made a terrible impression. He asked that a report come to Council about the future of the tower.

The General Manager Social Development, Connie Gibbons, said that a report would soon be coming to Council about this matter.

Cr Koce noted that a local paper had reported angst from Prahran Market traders about the Elizabeth Street car park. He asked when new arrangements would come into force and when their effectiveness would be assessed.

The General Manager City Works, Simon Thomas, said that a report was coming to Council which would outline various options for the Elizabeth Street car park.

Cr Sehr asked that Council Officers contact the owner of a building on the corner of Hornsby and James Street, Windsor, to have obscene graffiti removed.

The General Manager City Works, Simon Thomas advised he would have it follow up.

Cr Chandler gave notice that he would ask a question of Council Officers under Confidential Business.

H.Tabling of Petitions and Joint Letters

Cr Klisaris tabled a multi-signatured letter from ten residents of Malvern East objecting to Planning Application 0966/13 - 114-116 Argyll Street, Malvern East, on the grounds of: the distribution of misleading initial plans; and a VCAT ruling on an earlier development in the street.

Cr Chandler tabled a petition from 22 residents of Lambert Road and Orrong Road, Toorak, requesting the implementation of parking restrictions on Lambert Road, Toorak, as it is impossible to park in the street, particularly during business hours. The petition requests the following restrictions on Lambert Road from Orrong Road and extending 150 metres:

  • South side of Lambert Road: two hour restricted parking from 9am – 6pm Monday to Friday and resident parking at all times.
  • North side of Lambert Road: two hour restricted parking from 9am – 6pm Monday to Friday and Permit Zone restrictions at other times.

K.Reports of Delegates

Cr Ullin, as MAV delegate, reported as follows:

  • Kindergarten Funding Campaign:This is proceeding. The MAV is asking that all councils support them, writing to State and Federal Government politicians asking for funding for kindergartens.
  • Graffiti Removal: The State Government has made money available for councils in relation to graffiti removal. Cr Ullin expressed the hope that Council Officers were applying for this funding.
  • Robin Clarke Memorial Awards for Crime Prevention:Nominations for this award are now open. Cr Ullin noted that Stonnington Councillors may wish to submit nominations.
  • Anzac Program:The MAV is suggesting that Councils may wish to rename areas in honour of a person or event related to the Anzac period.

L.General Business

The Mayor (Cr Stubbs) read the following statement:

I wanted to make a statement in regard to a number of recent announcements.

Recently, Premier Denis Napthine, with the member for Prahran and Parliamentary Secretary for Education, Clem Newton-Brown MP, announced a $20 million commitment to a long-awaited state secondary school for Stonnington in Prahran.

This afternoon, I stood with the Minister for Crime Prevention, the Hon. Edward O’Donohue MLC and the Parliamentary Secretary for Education and member for Prahran, where the Minister announced that Stonnington has been successful in obtaining a Public Safety Infrastructure Grant of $250,000 towards Stage 2 of the Windsor Plaza Precinct Project.

This comes after Friday’s funding announcement by the State Government of the removal of the level crossing at Burke Road, Glen Iris.

On behalf of Council and residents, I want to thank the State Government, in particular our local member, the Honourable Michael O’Brien MP, Member for Malvern and Treasurer of Victoria, and the Honourable Terry Mulder MP, Minister for Public Transport, for this fantastic funding commitment.

It’s a win for residents and the Council, as the State Government has confirmed that our preferred design option – a rail under road solution – has been deemed the most appropriate solution at the site.

We look forward to working with VicRoads on a design that will greatly improve local access and connectivity in and around the Glen Iris small neighbourhood activity centre, including the construction of a new train station.

Council has been lobbying for this project for some time, so it’s wonderful to receive such good news which will provide far-reaching benefits for the local community and road users.

And finally, we now await approval by the Minister of Planning, the Hon. Matthew Guy MLC, approving Council’s submission regarding the implementation of the new residential zones that were submitted to his department in December 2013.

That a Notice of Decision to Grant a Planning Permit No: 0624/13 for the land located at 51 Chapel Street, Windsor be issued under the Stonnington Planning Scheme for part demolition and the construction of buildings and works for the purpose of dwellings in a Commercial 1 Zone, Heritage Overlay and Special Building Overlay and a waiver of the car parking and loading requirements subject to the following conditions:
1.Before the commencement of the development, three (3) copies of plans drawn to scale and fully dimensioned, must be submitted to and approved by the Responsible Authority. The plans must be generally in accordance with the application plans described as TP-01 to TP-10 (inclusive) date stamped 19 March 2014 but modified to show:
a)A revised notation stating that the existing chimney is to be retained;
b)Details of restoration works to the Chapel Street facade;
c)A written statement from a suitably qualified and experienced heritage architect in accordance with Condition 3 of the permit;
d)Schedule of construction materials, external finishes and colours;
e)Details of the type of bicycle storage (including product specifications) to be installed and demonstration that the relevant Australian Standards are met;
f)A revised Section Plan (TP-07 – date stamped 19 March 2014) to remove reference to ‘U5’ and replace with ‘U4’;
g)A revised Sustainable Design Assessment (SDA) in accordance with Condition 4 of the permit;
h)A Waste Management Plan in accordance with Condition 5 of the permit;
i)An Acoustic Report in accordance with Condition 6 of the permit; and
j)Plan notations indicating that the visible northern and southern external walls are to be finished in patterned or textured concrete.
2.The development must be in accordance with the endorsed plans unless otherwise agreed in writing by the Responsible Authority.
3.Concurrent with the endorsement of plans, a written statement from a suitably qualified and experienced heritage architect which details how the restoration works to the Chapel Street facade will return the building to the known early state, to the satisfaction of the Responsible Authority.
4.Concurrent with the endorsement of any plans, a revised Sustainable Design Assessment (SDA) must be submitted to and approved by the Responsible Authority. Amendments to the SDA must be incorporated into plan changes required under Condition 1. The revised report must be generally in accordance with the SDA submitted with the application prepared Energy Water and Environment dated 9 July 2013, but modified to show:
