PESTICIDES (IMPORTATION FOR EDUCATIONAL OR

RESEARCH PURPOSES) (AMENDMENT) RULES 1987

IN exercise of the powers conferred by section 57(1) of the Pesticides Act 1974, the Minister, having consulted the Pesticides Board, makes the following rules:-

Citation and commencement

1. These Rules may be cited as Pesticides (Importation for Educational or Research Purposes) (Amendment) Rules 1987 and shall come into force on the 1st. September 1987.

Interpretation

2. In these rules `permit' means a permit under section 14 of the Act to import pesticides for educational or research purposes.

Application for

3. (1) An application for a permit a permit must be made in two copies in form A in the Schedule.

(2) Separate applications must be made for different consignments of pesticides.

(3) If several [* different] pesticides are to be imported in a single consignment they may be included in a single application.

The permit

4. (1) The permit is in Form B in the Schedule.

(2) All the pesticides included in one application may be included in one permit.

(3) The period within which importation is to be allowed by a permit shall not exceed six months.

Fee

5. (1) The fee for a permit is ten ringgit and must be submitted together with the application.

(2) The fee is not refundable if the application is refused.

Importation

6. If a pesticide is imported for another organization, another organization, institution, institution, or person, the holder of the permit shall not dispose of the pesticide except to that organizations, institution, or person.

Use of

7. An organization, institution, or pesticide restricted person for whom a pesticide is imported, to technical employees or a permit holder who imports a pesticide for his own use, shall not permit the pesticide to be used except by technical employees of the organization, institution, person, or permit-holder, as the case may be.

Destruction of

8. (1) If a pesticide imported under contaminated crops a permit has at any time been used on any short-term plant, the person entitled to the crop shall cause the whole crop harvested from the plant to be destroyed.

(2) If a pesticide imported under a permit has been used on any long-term plant, the person entitled to the crop shall cause all crop harvested from the plant within three months of the last application of the pesticide on the plant to be destroyed.

Prohibition

9. (1) No person shall use as food as animal of contaminated or animal feed, or dispose of for such crops as food or animal feed. Use, any short-term crop that he knows or has reason to believe or suspect to be crop harvested from a plant on which a pesticide imported under a permit has at any time been used.

(2) No person shall use as food or animal feed, or dispose of for such use, any long-term crop that he knows or has reason to believe or suspect to be crop that he knows or has reason to believe or suspect to be crop harvested from a plant within three months of the last application on the plant of a pesticide imported under a permit.

10. The Board may with or without conditions exempt any person from any of the provisions of rules 8 and 9 in any particular case.

11. Any person who contravenes rule 6, 7, 8 or 9 or any condition of any exemption under rule 10 commits an offence.
