MINUTES OF THE MEETING FOR SEPTEMBER 5, 2012

A Fund to Combat Violent Crime Committee meeting was held on Wednesday, September 5, 2012, 1000 a.m. in the City of Dover Police Department conference room, 400 South Queen Street, Dover, Delaware. Chairman Lewis Schiliro opened the meeting by thanking all of the police chiefs for their quick response to the application process and noted there was 100% participation by the eligible police departments. Chairman Schiliro also thanked Debby Golden for her administration of the program in a timely manner.

The agenda was as follows:

I.  Approval of May 15, 2012 Minutes of the Meeting

Chairman Schiliro asked if there were any amendments to the May 15, 2012 minutes of the meeting and hearing none, asked for a motion for approval. A motion was made by Tim Mullaney and seconded by Chief James Hosfelt that the May 15, 2012 minutes be approved as submitted. Hearing no discussion, the minutes were approved by the Committee members.

II.  Approval of FY 13 Fund to Combat Violent Crime Applications

Chairman Schiliro asked the Committee if they reviewed the following applications and had any comments: (Comments start on page seven)

V-01-13 Greenwood Police Department $8,583.59

Applicant requests approval to use funds for overtime to conduct surveillance by undercover vehicles and foot/vehicle patrols in both residential and business communities ($3,291.58); to purchase 4 stop stick rack kits ($1751.25); 4 Steiner binoculars ($1368); 4 digital cameras ($1540); 4 memory cards ($83.96); 2 camera warranties ($81); 4 camera cases ($67.80); and undercover motor vehicle rental ($400).

V-02-13 South Bethany Police Department $17,167.18

Applicant requests approval to purchase 4 Motorola Portable XTS5000 model 11 radios; Astro digital CAI operation software; and 1 DES, DES-SL, DES-OFB encryption.

V-03-13 Delaware City Police Department $8,583.59

Applicant requests approval to use funds for overtime to be used to work with and assist Probation and Parole in checking on curfew violators and execute pending outstanding warrants by Delaware City Police ($3,702.79) and to purchase 1 APX 6000 Motorola Radio ($4,880.80).

Applicant requests approval to use funds to upgrade 12 Glock 23 to Sig Sauer DAK .357 weapons to include holsters, tactical mounted lights, magazine pouches, and training ammo and to purchase 1 Colt AR-15 rifle with training ammo, forearm light and departmental engraving on all weapons.

Applicant requests approval to use funds for the development of a Tactical Patrol Officer (TPO) Program. TPO training will include patrol rifle training, active shooter response, tactical casualty care, ballistic shield use, tactical pistol, and planning and response to violent critical incidents.

V-18-13 Wilmington Police Department $127,693.50

Applicant requests approval to use funds for overtime which will focus on intelligence driven data of violent crimes, yielded from a weekly Deployment meeting. The program will encompass walking assignments, crime prevention programs for at-risk youths and tactical response initiatives.

V-19-13 Dagsboro Police Department $8,583.59

Applicant requests approval to purchase 1 Astro digital radio ($4,338.80) and towards the purchase of start-up costs for a K-9 to include siren, light package and bar with controls, Havis K-9 kennel and Acer Hot and Pop Pro alarm/door pop system ($4,244.79).

Applicant requests approval to use funds for overtime ($5,161.48); to purchase 1 Watchguard in-car digital video recorder to include installation, set up licenses, etc. ($10,095); and training to include Patrol Response to Active Shooter and Gang Violence/Violent Crimes ($5,161.48).

Applicant requests approval to use funds for tactical training ($3,300); to upgrade Glock service weapons ($2,200); purchase 1 Panasonic Toughbook Ultra ($2,700); 6 EOTECH weapon sights ($3,000); and upgrade tasers to the latest model ($7,050.77).

Applicant requests approval to use funds for overtime to provide 2 officer foot patrols in targeted areas ($5,773.72) and to purchase 1 mobile video camera server and software ($14,956) and 1 Flashback 2 in-car video system ($4,745).

Applicant requests approval to purchase 1 Digital Ally in car surveillance camera ($4,337.70); to send police officer to training given by the National Crime Prevention Association entitled “Skill building 24 Hour Basic Crime Prevention” Course in Columbia, SC ($1,350); and overtime for increased surveillance in known drug areas ($2,173.50).

V-35-13 Harrington Police Department $18,611.97

Applicant requests approval to purchase 4 Sig S16 rifles and ammo ($7,165.50); camera for crime scene ($446.47); training ($1,000); and overtime for drug and crime prevention ($10,000).

V-36-13 Delmar Police Department $19,695.56

Applicant requests approval to use funds to purchase 3 Outdoor IP Pan Tilt Zoom Cameras w/licenses and labor for installation ($15,373.56); 1 Dell OptiPlex desktop computer with software ($1,600); training for 2 officers in Burtonsville, MD on Video Forensics ($2,722).

V-37-13 Blades Police Department $8,583.59

Applicant requests approval to use funds for overtime to conduct patrol coverage to prevent and deter violent crime activity.

Discussion: Tim Mullaney stated for the record that Newark Police Department’s purchase of a vehicle was permissible because it does not fall under Chapter 5, p. 12, §3 of the guidelines, “What may Fund to Combat Violent Crime funds NOT be used for?”

which states: “The purchase or leasing of equipment needed in order to justify the existence of a police agency (i.e. uniforms, weapons, vehicles, equipment specifically designed for traffic enforcement, telephones, cell phones, pagers, office supplies and utilities” because this vehicle was being used for as a Special Operations vehicle and not a normal budgeted police vehicle. Captain John Potts, Newark Police Department, stated that was accurate and the vehicle was to be used by Newark’s Special Operations unit. DAG Tom Ellis concurred by stating this was consistent with his view.

Chief William Phillips, Milton Police Department, stated that he would like to amend his grant deleting the purchase of 1 Tactical K-9 door popper and heat sensor system with installation for $1,054.17 and replacing it with the purchase of 11 digital voice recorders and 2 camcorders. There is no change in the dollar amount.

Chairman Schiliro asked for any other comments or discussion and hearing none, called for a motion to approve the grant applications.

Motion for Approval: A motion was made by Tim Mullaney and seconded by Chief Jim Hosfelt to approved the grant applications, with Milton’s amendment. Hearing no further discussion, the applications were unanimously approved by the Committee members.

Chairman Schiliro stated that the Committee would like to encourage the police departments to be more strategic in the use of funds next year. The Committee would like to see specific issues addressed and police departments working together as a task force addressing specific issues. Chairman Schiliro has asked Colonel Coupe to prepare statewide crime statistics addressing areas needing specific attention. Chairman Schiliro hoped to have this presentation ready at the January Committee meeting.

III. Other Business

A.  FOIA

Chief William Phillips, Milton Police Department, was concerned that the Violent Crime Committee meeting was posted on the State of Delaware internet , in accordance with the Freedom of Information Act, making it accessible to criminals seeing what types of surveillance equipment Milton and other police departments were purchasing. Chief Phillips stated this could jeopardize officer safety.
