TheevidenceofMrBrownprovidesdirectevidence,backedbyminutesofmeetings heattended,documentstabledatthosemeetings,reportsprovidedtotheauditorsand reportsreceivedbytheNationalExecutive,aboutthe followingmatters:
a. In December2007 exitauditwasordered afterMrThomson ceased to beNationalSecretary(paragraphs132-133).
b.Arising from an interim reportfrom the auditor, Ms Jackson and Mr WilliamsonreportedtotheNationalExecutiveinMarch2008(atwhichMr Brown attended) about apparent financial irregularities, large cash withdrawals, theuseofaCommonwealthBankMasterCardthattheauditor waspreviouslynotawarehadexistedandexpenditureonitemsthatdidnot appeartohaveanythingtodowithUnionbusiness(paragraph134).
c.AtthatNationalExecutivemeetingMsJacksonandMrWilliamsoncirculated aproposedresolutionthattheexitauditintothese mattersbediscontinuedand thatMrThomson’s expenditureberetrospectivelyauthorised(paragraph137).
d. A resolutionwaspassed topermitfurtherinvestigation andtoimplementFinancial Governance Procedures that Brown and others had drafted (paragraphs139-141).
e.InMay2009,amonthafterthenewFinancialGovernanceProcedureswere putinplace,MsJacksontransferred$18,251ofVictorianNo3Branchfunds toMrThomsonwithouttheauthorityofanyotherofficer(paragraph150 - 152(c)).
f.InJunetoDecember2008threeofficers(includingMrBrown)investigated theallegedmisconductby Thomson.TheyprovidedareporttoNational Executive(paragraphs143-149).
g.InDecember2008thereportofthethreeofficerswasreferredtotheUnion's solicitorsandafirmofaccountants,BDOKendall,toinvestigateandreport onthematter(paragraphs180-184).Theevidenceat175- 179answersthe questionsaskedincounselassisting’s opening-whywasn'tsomethingdone aboutit? Whathappenedwhenitwasdetected?(T528.30).Italsoaddresses thesuggestionthattheunionwasseekingtocoverupforMrThompson.
h. In April 2009 the allegations against Thompson appeared in the media. Thompson threatened to sue the Union for defamation. The NationalExecutivereceivedreportsontheinvestigationinAprilandJune2009.The reportswerekeptconfidential.MsJacksonstatessheobjectedtothatcourse (JacksonMFI1paragraph61).Thematterwasthenreferredtotheregulator: seeparagraphs 194-206.The evidenceagainaddressestheissues -why wasn'tsomethingdoneaboutthecorruptionandwhathappenedwhenitwas detected(T528.30).Theevidenceaddressesthecriticismthatthedocuments were kept confidential and explains why the matter was referred to the regulator(FWA)andnotthenreferredtothepolice(paragraphs199-201). It dealswithMsJackson'scontentionthatsheobjectedtothecourseof keeping thereportconfidential(paragraphs196,197,202,203). Brownwaspresentat allofthesemeetingsofNationalExecutive andNationalCouncil.

MsJacksondatesthedeteriorationoftherelationshipwithNationalExecutiveto24August 2011.Asnotedabove,sheallegesthatshewas‘hounded bytheNational Executivewho,inmyview,'wentferal’ andthereafterappearedtocolludewithMr Williamson’s strategytodefeattheallegationsthatIhadmade’ (JacksonMFI1at paragraph192,T747-T751). TheNationalExecutiveissaidtohavebecome'even moreferal' after28August 2011(JacksonMFI1paragraph 211) and thatbyits actions, and the stress it caused,Ms Jackson became unwell (T758.1). She saysresolutionspassedattheNationalExecutiveinNovember2011werea‘pay off’ to'defeatthechallengetoWilliamson'scorruption’ (JacksonMFI1paragraph312).Insubstance, Ms Jackson contends that she was victimized by National Executive becauseshereferredmattersto thepoliceaboutThomsonandWilliamson.
The Commission hasadmitted(orcounselassistingproposestoadmit)paragraphs thatsummarisetheresponseofBrownto theseallegations:paragraphs267-272. Paragraphs273-310ofBrown providethedetailbehindthatsummary.Theyare necessarytofullyaddresstheseriousaccusationsthathavebeenmade.MsJackson suggeststherewasa'payoff.Brownisinthebestpositiontodescribeindetailwhat Williamsonagreed(paragraphs277-310).Browndescribesinoneoftheadmitted paragraphs (paragraph270)thatJacksonwasdisrespectedalmostuniversallywithin thesmallbranches'groupwhoformedthemajorityofthe membersofnational Executive.AsBrownexplainsinparagraph122,thatlack ofrespectpredatedMs JacksonblowingthewhistleonWilliamsonortakinganystepconcerningThomson. That wouldleadtheCommissionintoanewfactualinquiry,includingastothematterwhich gaverisetothedefamationproceedingsandtheproprietyofthesettlementreached. It is necessary to evaluate whetherfreshand untested allegations byMr Brown which are damagingtothereputationsofMsJackson,MrJackson,MrElliottandMrWilliamson havesufficientmaterialitytotheCommission'sinquiryandsufficientprobativevalueto warrantthembeingadmittedintoevidenceinallthesecircumstances. CounselAssisting submits that,inallthecircumstances,itisnotappropriatethat MrBrownmakethese untestedallegationsinevidence.
