ADOPTINGPREQUALIFICATIONQUESTIONNAIRE,

FINANCIAL STATEMENT,UNIFORMSYSTEM

OFRATINGPOTENTIAL BIDDERS AND APPEAL PROCESS

PURSUANTTOPUBLICCONTRACTCODESECTION20111.6

WHEREAS,PublicContractCodesection20111.6requiresschooldistrictswith an average daily attendance of 2,500 or more toprequalifycertain prospectivebidderspriortobiddingonpublic projects of one million dollars ($1,000,000) or more for which the District uses funds received pursuant to the Leroy F. Greene School Facilities Act or any funds from any future state school bond (“Projects”) by having prospective bidders complete and submitastandardizedquestionnaireandfinancialstatement;

WHEREAS,DistrictstaffhasdevelopedastandardizedquestionnaireandfinancialstatementinaccordancewithPublicContractCodesection20111.6,attached hereto as Exhibit A (collectively"Questionnaire");

WHEREAS,theQuestionnaireincludesaprocessforpotentialbidderstoappealcertaindecisionswithrespecttotheprequalificationprocess("AppealProcess");

WHEREAS,PublicContractCodesection20111.6requirestheDistricttoadoptand apply a uniform systemofratingbiddersonthebasisofthecompletedQuestionnaires;

WHEREAS,Districtstaffhasdevelopedauniform systemofratingpotentialbiddersbaseduponthecompletedQuestionnaires("RatingSystem");

WHEREAS,theDistrictdesirestoadopttheQuestionnaire (including the Financial Statement and Appeals Process) and the RatingSystem(collectively,the"PrequalificationPackage");

NOW, THEREFORE,theGoverningBoard ofthe SchoolDistrictherebyfinds,determines,declares,ordersandresolvesasfollows:

Section1.Thattheaboverecitalsaretrueandcorrect.

Section2.ThatthePrequalificationPackageisconsistent with the requirements of PublicContractCodesection20111.6.

Section3.ThattheDistrict'sAssistant Superintendent for Business,orhis/herdesignee,isauthorizedtoimplementaprequalificationprocessconsistent with thePrequalificationPackageandPublicContractCodesection20111.6 for all Projects, as defined, and that said Assistant Superintendent for Business or his/herdesignee shall have the authority to determine whether a potential bidder shall be considered prequalified.
