TRANSFER
Transfer / shifting will be chargeable from bookingdatesubject to receipt ofminimum25% of the Basic Selling Price andclearance ofany otherdues,outstandings/interest, transfers will be charged @ Rs1% of Current market value transfers within immediate blood relationswill befree ofcharge.
Transfersrules prevailing at the time of booking shall apply. Transfers will besubject to acceptanceby the company.
POSSESSION
The Company shall endeavor to give possession of the Plot to the applicant(s) intending allottee(s) in a period of …………………………………. from the date of agreement approximately with an extension of 6 months, from the date of execution of Sale Agreement subject to force-majeure circumstances, and reasons beyond the control of the company and subject to receipt of the complete dues and other charges as per monthly installment plan opted by the allottee(s).Possession of unit depends solely on the timely payment of all EMI as mentioned in the agreement delay of EMI or non – payment of installments for more than three months may lead to cancellation, delay in possession or reallocation of the said plot only after clearance of present dues. The applicant/intending allottee shall be entitled to receive compensation as mentioned in “Compensation for delay” clause. The intending allottee(s) shall take possession of the said residential Plot/Unit within such period as may be mentioned in the “Offer of Possession” issued by the company.
Compensation for Delay in Possession
In case the company is unable to deliver possession of the Bungalows to the allottee(s) within the stipulated time (subject to Force Majeure reasons as stated herein above), then the company shall pay compensation to the allottee(s) @ 7% p.a. on the payment received for construction i.e. above 50% of the Total Consideration and from clause no. ‘4’ to clause no. ‘8’ as mentioned in payment schedule.
Note: In case of non-payment after the generation of demand for construction no compensation shall be payable by the company and @ 7% p.a. delay payment charges shall be levied to allottees for the period of delay.
CANCELLATION/ SURRENDER
In case theapplicantcancels/surrenders his/her Booking at any time before issue of Provisional Allotment Letter, the company will be entitled to deduct Rs. 20,000/- & Post issuance of the Allotment Letter, if the Applicant(s) cancels/surrenders his/her Booking, the company will be entitled to deduct 10% of the Total Consideration towards administrative charges and return the balance amount without interest within 120 days of receiving a written application from theapplicant.
Delay in installment after issue of Provisional Allotment Letter will attract interest @7% pa. However, if the delay exceeds a period of 90 days from due date, the company will be entitled to cancel the booking and forfeit the entire Earnest Money Deposit comprising 10% of the Basic Sale Price.
Under both the above stated factors, the company shall have the right to sell the said intended Unit to any other party without giving any notice or recourse to theapplicant.
GENERAL TERMS
This booking will not tantamount to deemed allotment of the Unit applied for. Acceptance of this booking form and subsequent allotment, if any, is at the sole discretion the company.
Thisbooking will be guided by the termsof payment and other terms as set out inthe company Application Form and Buyer's Agreementthatthe applicant hasbeen shownand apprised with.
The applicant shall sign the detailed company Application Form/ Buyer's Agreement and Maintenance Agreement as and when demanded by the company and pay Stamp Duty and Registration Charges for execution of the Sale Deed.
The applicantshall be liable to pay on demandcharges toward VAT/ Service Tax and any other tax/s by whatsoever nomenclature, whether levied previous to the execution hereof or at any time after the execution hereof, failing which the applicant shall be solely liable for the consequences thereof and the company shall have no liability whatsoever in that regard.
The Unit is part of a Larger Layout as tentatively shown on the plan and the terms and conditions of the Layout to the extentas applicable tothe applicantwill bebinding uponhim/her. Thelocation of premises as shown on the plan is only to indicate applicant's preferenceandisnot binding upon the Company.
TheCompany has informedthe applicantthat all the plans, drawings, amenities etc. are subject to the approval of the respective Authorities and subject to change. Further, theCompany has all the right to changethe plans/plots, specificationsor features without prior notice or obligations andthe applicantwill notobjecttoanymodifications/amendmentsof plans/designs and/oradditions to the project.
APPLICABLE LAWS AND JURISDICTION
Any disputesshall be governed by the laws of India. It is agreed by and between the parties hereto that all and any disputes, suits, complaints, litigation, claim or any other matter arising out of or in relation to thisbooking, shall be resolved by the Courts of Kolkata, West Bengal.
