Please read each paragraph in this Agreement and initial to confirm that you agree to and understand these terms and conditions of this adoption.
___1)Adopter will be responsible for all future medical care and health maintenance for Pet and will seek immediate veterinary care if Pet is ill or injured. Heartworm preventative will be given to Pet monthly, and all immunizations required by law will be kept current according to a veterinarian’s schedule. Adopter understands that this obligation is for the lifetime of Pet.
___2)If Pet is not spayed or neutered at the time of adoption, the Adopter agrees to provide proof to ARF of such procedure prior to the Pet reaching 6 months of age, or immediately if the Pet is already 6 months old.
___3)Adopter will microchip Pet, if not already microchipped. Adopter willprovide and keep up-to-date owner identifying information to the relevant microchip company.
___4)Pet will be kept as a companion animal. Adopter will not ever chain or tie Pet to a rope and leave Pet unattended for extended periods of time. When not in a fenced enclosure, Pet will be walked on a leash. Adopter will provide a) shelter, b) adequate food and water, c) kind and loving human interaction, and d) a secure fenced area for Pet, if Pet is to be kept outside. Pet may not be used for commercial or experimental purposes.
___5)Pet may not be physically altered in any manner (docking tails, cropping ears, etc.)
___6)Pet will wear a collar at all times, with current rabies and identification tags attached.
___7)If Pet should be impounded by any animal control agency, Adopter will reclaim him/her immediately, and pay any required fees in connection with the release of Pet. If lost or stolen, Adopter will make all reasonable efforts to recover Pet.
___8)Animal Rescue Foundation, Inc. (“ARF”) does not make any guarantees regarding the age, nature, temperament, or health of Pet. Adopter assumes all risks and responsibility of ownership of Pet once it is in his/her possession, and ARF is not in any way responsible for any cost incurred.
___9) If Adopter fails to fully and timely comply with the terms of this Agreement, Adopter will immediately and voluntarily relinquish ownership, custody, possession and control of Pet to ARF.
___10) This Agreement shall be governed by Texas law and venue and jurisdiction of any disputes between the parties related to this Agreement shall be Guadalupe County, Texas courts.
___11) Adopter agrees to comply with all state, federal and local laws, ordinances, and regulations related to pet ownership.
___12) I am at least 21 years of age.
___13) In consideration of my adoption of Pet, I hereby accept all risksof personal injury, property damage, and all other losses related to Pet from the date this Agreement is signed forward. I hereby release Animal Rescue Foundation, Inc., its governing board, officers, employees and representatives fromany liability to me, my personal representatives, estate, heirs, next of kin, and assigns for anyand all claims and causes of action for loss of or damage to my property and for any and allillness or injury to my person, including my death, that may result from or occur related to Pet, whether caused by negligence of Animal Rescue Foundation, Inc., its governing board, officers, employees, or representatives, or otherwise.
I further agree to indemnify and hold harmless Animal Rescue Foundation, Inc. and its governing board, officers, employees, and representatives from liability for theinjury or death of any person(s) and damage to property related to or caused by Pet.
“I have carefully read this agreement and understand it to be a release of all claims andcauses of action for my injury or death or damage to my property that occurs related to Pet. I understand and agree that it obligates me toindemnify the parties named for any liability for injury or death of any person anddamage to property related to Pet and my ownership thereof.”
