FY 07/08 Bonus Implementation Instructions

INSTRUCTIONS FOR IMPLEMENTATION OF THE

NOVEMBER 1, 2007, NON-RECURRING ONE-TIME LUMP-SUM BONUS PAYMENT

FOR

CAREER SERVICE, SELECTED EXEMPT SERVICEAND

SENIOR MANAGEMENT SERVICE EMPLOYEES

These instructions shall be used for implementing the November 1, 2007, non-recurring one-time lump-sum bonus payment provided for in the 2007-2008 General Appropriations Act for eligible Career Service, Selected Exempt Service, and Senior Management Service employees. This includes employees represented by the Florida Police Benevolent Association (PBA), the Florida State Fire Service Association (FSFSA), the Florida Nurses Association (FNA), the American Federation of State, County and Municipal Employees, Council 79 (AFSCME), the Federation of Physicians and Dentists (FPD), and the State Employees Attorneys Guild (SEAG), as well as all other eligible employees not represented by a collective bargaining unit.

ELIGIBILITY REQUIREMENTS

  • Eligible employees are employees who are, at a minimum, meeting their required performance standards on November 1, 2007. Employees achieving performance standards subsequent to November 1, 2007, are not eligible to receive the bonus.
  • To receive the non-recurring one-time lump-sum bonus payment, the eligible employee must have been continuously employed by the state from July 1, 2007, (Sunday) through November 1, 2007. If an employee is hired effective July 2, 2007, (Monday) they are not eligible to receive the bonus.

GENERAL INSTRUCTIONS

  • Effective November 1, 2007, each eligible full-time employee shall receive a non-recurring one-time gross lump-sum bonus payment of $1,000.
  • The non-recurring one-time lump-sum bonus payment for part-time employees shall be prorated based on the November 1, 2007, full-time equivalency (FTE) of the position.
  • Eligible employees on leave without pay on November 1, 2007, shall receive the non-recurring one-time lump-sum bonus payment effective November 1, 2007, not the date they return to pay status.
  • Preliminary reports for the non-recurring one-time lump-sum bonus payment will be sent to agencies no later than close of business Friday, September 28, 2007. These reports are for agency review and approval prior to Convergys processing the bonus. Agencies will need to submit their final spreadsheet of eligible employees back to their DMS Change Management Lead by close of business Wednesday, October 10, 2007.
  • The non-recurring one-time lump-sum bonus payments will be processed on a November 1, 2007, special payroll with a warrant date of November 7, 2007.
  • Additional bonus payment processing guidance will be provided to agencies in the near future.

CALCULATING OVERTIME PAY FOR NON-EXEMPT EMPLOYEES

The Fair Labor Standards Act (“FLSA”) requires that all non-exempt employees (i.e. those who do not fit into one of the FLSA’s defined exemptions), be paid overtime at time and a half of their “regular rate of pay” for all hours worked over 40 in a workweek. The regular rate of pay is the rate at which overtime is calculated, and includes more than just the employee’s normal salary or hourly rate. Since this bonus is non-discretionary, it must also be included in the “regular rate of pay” for the purpose of calculating overtime payments. The timeframe for including the bonus in the calculation of overtime payment is the workweek beginning October26, 2007, and ending November 1, 2007.
