BOARD OF ADJUSTMENT MINUTES

MAY 9, 2012

The May 9, 2012 regular meeting of the Borough of Totowa Board of Adjustment was held at the Municipal Building. Vice Chairman Krautheim called the meeting to order at 8:00 p.m.; followed by the Flag Salute. Attorney Brigliadoro read the Open Public Meetings Act.

Roll Call:

Present: Vice Chairman Krautheim, Commissioner Niland, Patten, D’Ambrosio, Mancini, Alternate Korsakoff, Alternate Cortese, Attorney Brigliadoro, Engineer Murphy, Secretary Rattino.

Excused: Commissioner Fierro, Attorney Saracino.

A motion to accept the minutes of the March 2012 and April 2012 meetings was made by Commissioner Patten and seconded by Alternate Korsakoff. On a roll call vote all Commissioners present voted in the affirmative.

1ST CASE:JGN MASSAGE, LLC

650 UNION BOULEVARD, BLOCK 143, LOT 1

Service in order. Applicant requesting necessary variance(s) for a massage establishment in B-2 zone. Represented by Neil Nosenchuk, Esq. This proposed therapeutic massage establishment was described to the Board. Also reviewed were the hours of operation, number of employees, parking, etc. This location is in Totowa Village. The letter of intent was read into record. The layout of the business was discussed. All employees are licensed by the state of New Jersey; licenses are renewed annually. The space and signage was reviewed. Engineer Murphy felt that the proofs/positive criteria/special reasons has been satisfied. Engineer Murphy confirmed that there is a variance relief for licensing requirements in order to operate. A condition of approval is that the signage stays consistent with signage at site. There is a 20% maximum on banners in the windows. There was no public to be heard.

A motion to grant the necessary variance(s) was made by Alternate Korsakoff and seconded by Commissioner Patten. Vote to grant: 7-0. (Tape #1, #1 - #878).

2ND CASE:PURE HEALING SPA

79 UNION BOULEVARD, BLOCK 11, LOT 6.01

Service in order. Applicant requesting necessary variance(s) for a massage establishment in B-2 zone. Represented by Matthew Jeon, Esq. The packet was distributed to the Board and reviewed. Jinho Kim, Architect and Jay Song, Applicant/Owner, were sworn. Mr. Kim reviewed the interior and exterior plans with the Board. The square footage is 1410. The services are almost identical to the prior applicant. They will comply with all Borough requirements. They are all licensed. The hours/parking was discussed. Mary Park, Aunt to run the business for Jay Song, was sworn. There will be no overnight guests at the facility. The positive criteria for this application was satisfied. They will comply with all ordinances, requirements, etc. The property lies in two different zones and does not impair zoning in this area. The packet of licenses was marked Exhibit A1. The signage will follow Borough code; they will replace existing signage. The 20% maximum for the windows was discussed. There was no public to be heard.

A motion to grant the necessary variance(s) was made by Alternate Cortese and seconded by Commissioner D’Ambrosio. Vote to grant: 7-0. (Tape #1, #878 - #2353).

A motion to adjourn the meeting was made by Commissioner Patten and seconded by Commissioner D’Ambrosio. The meeting ended at 9:25 p.m.
