Waiver, Assumption of Risk and Agreement to Hold Harmless andIndemnify
I, the undersigned, understand that attendance at a dog training class or Doggie Daycare is not without risk to myself, my dog, members of my family or guests who may attend because some dogs to which I (we) may be exposed may be difficult to control and may be the cause of injury or property damage even when handled with the greatest amount of care. In addition, I also understand that while under the care of Liz Blasio and agents my dog will co-mingle with animals of different ownership, and be housed in appropriately sized kennels at necessary times.
I hereby agree to release Liz Blasio, her agents, and clients of other dogs from any and all liability of any nature for personal injury or property damage which I or my dog, my family members or guests, may suffer including, but not limited to, any claim resulting from the action of any dog, myself, other students or dogs, instructors, the facilities, both real and personal, including claims arising from sidewalks and any parking lots, bathrooms or steps. Included in this is the right of Liz Blasio and her agents to determine without liability if veterinary care is required in cases of illness, injury, or death. We are required by the Colorado Department of Agriculture to have a vet on file that will hold your pet at their facility until your return in case of death.
I hereby agree to indemnify, hold harmless and defend Liz Blasio the owner of the facility from any and all claims by any member of my family or any person accompanying me or any third party whatsoever while at training or at any function of Liz Blasio while on the grounds or the surrounding areas and any and all claims for bodily injury and property damage brought as a result of any action of myself or any dog while under my control or direction. This indemnity, hold harmless and defend agreement applies even to acts of negligence of Liz Blasio and is intended to cover claims brought against Liz Blasio, her agents or any action of my dog while in training or elsewhere including but not limited to claims of failure to train said dogs.
This Waiver is a release of any and all claims, demands, damages, actions, causes of action, or suits at law or in equity of whatsoever kind of nature for or because of any manner or thing done, omitted, or suffered to be done by Liz Blasio prior to and during the period of time I am using her property.
In addition to the above described Waiver, I herewith and hereby covenant no to cause any litigation to be filed against Liz Blasio and to hold her harmless and indemnify her for any litigation which is filed against her, or claims made against her which litigation or claims are based on my conduct.
