NONPUBLIC,NONSECTARIANSCHOOL ANDAGENCYSERVICES FORSPECIAL
EDUCATION POLICY
Nonpublic, nonsectarianschool (NPS) and agency(NPA)services shall beavailableto pupils in theShasta CountySELPA. When no appropriatepublic educational servicesare availablewithin theShasta CountySELPA, neighboring counties orSELPAs, or statespecial schools, adesignated memberoftheIEPteam ortheShasta County SELPA Directorshall contact theLEA Superintendent/designeeifthis typeofplacement might be consideredat an upcoming IEPmeeting.
TheLEA maycontractwith state-certified nonpublic, nonsectarian schools oragencies to providespecial education services orfacilities when an appropriatepublic education program is not available.
When enteringinto agreements with nonpublic, nonsectarian schools oragencies, theLEAshall considertheneeds oftheindividual student and the recommendations ofthe individualized education program (IEP)team. TheIEPteam shall remain accountable for monitoringtheprogress ofstudent placed in nonpublic, nonsectarian programs towards thegoals identified in each student’sIEP.

Placement and Services
Note: As amended in Register99, No. 13, 5 CCR3060 and 3061 specifynew requirements regardingspecial education classes offered in non-public, nonsectarian schools and agencies. These requirements detail thestaffing requirements forinstructors, includingthecredentials that instructors must hold; theeligibilityrequirements forsuch credentials; and thenumberof instructors required perschool oragency. Pursuant to 5 CCR30664, theCaliforniaDepartment ofEducation mayissueconditional certifications to allow agencies and schools timeto comply with thenew requirements.
Procedures specified in law shallgovern theselection of appropriatenonpublicschool oragency services.

Contracts with anonpublicschool oragencyshallinclude an individual services agreement (ISA) negotiated foreach student.Individual services agreements shall beforthelength oftime for which nonpublic, nonsectarian school services arespecified in thestudent’sindividualized education program (IEP),not to exceed oneyear.Changes ineducational instruction, services or placement shall bemadeonlyon thebasis ofrevisions to thestudent’sIEP.(Education Code

Themaster contract shallspecifythegeneraladministrative and financial agreements between thenonpublic, nonsectarian school oragencyand theLEA to providethespecial education and designatedinstruction and services,as well as transportation specified in the student’sIEP. The administrativeprovisions ofthe contract shall also includeprocedures for record keepingand documentation, and themaintenanceofschool recordsbythecontracting LEA to ensurethat appropriatehigh school graduation credit is received bythestudent. The contract mayallow forpartial or full-time attendanceat thenonpublicnonsectarian school. (Education Code56366)
Note: Thenonpublicschool or agencymust becertifiedas meetingstatestandards pursuant to Education Code56366.Contracts maybeterminated forcausewith 20 days’notice; however, the availabilityofapublic education program initiateduringtheperiod ofthe contract cannotgive cause fortermination unless theparent/guardian agrees to transferthestudent to theprogram.
Themaster contract shallincludeadescription oftheprocess beingutilizedbytheLEA
to overseeand evaluateplacements in nonpublic,nonsectarian schools. This description shall

TheLEA Superintendentordesigneeof anelementaryLEA shall notifyahigh school district of all students placed in nonpublicschool oragencyprograms priorto the annual review oftheIEP for each student who maytransferto thehigh school district. (5 CCR3068)
When aspecial education student meets thedistrict requirements for completion ofprescribed courseofstudyas designated in thestudent’sIEP,thedistrict which developed theIEPshall award thediploma.(5 CCR3069)
Out-of-StatePlacements
Before contractingwith anonpublic, nonsectarianschool oragencyoutsideCalifornia, the LEA Superintendent ordesigneeshall document thedistrict’s efforts to find an appropriateprogram offered byanonpublic, nonsectarian school oragencywithin California. (Education Code56365)
Within 15 days ofanydecision for an out-of-stateplacement, thestudent’sIEPteam shall submit to theSuperintendent ofPublicInstruction areport with information about theservices provided bytheout-of-stateprogram, the related costs, and thedistrict’s efforts to locate an appropriate publicschool ornonpublic, nonsectarian school oragencywithin California(Education Code

IftheLEA Superintendent decides to placeastudent with anonpublic, nonsectarian school oragency outsidethestate, theLEA shall indicatethe anticipated dateofthestudent’s return to a placement within California and shall document efforts duringthepreviousyearto return the student to California (Education Code56365)
Placement Procedures
TheLEA Superintendentordesigneeshall review all documented efforts to utilize all publicschool options priorto utilizingan NPSorNPA. TheLEAwill process referrals and locatean appropriatenonpublicschool to meet thestudent’s needs. TheShasta CountySELPA mayassist and/or collaboratewith theLEA to locate an appropriate NPS.
Each LEAagrees to usetheMasterContract andISA adopted bytheShasta CountySELPA. TheSELPA officewill ensurethat theMasterContract has been approved by theShasta CountySELPA legalcounsel and is updated per federal orstate requirements. TheNPSis required bytheMasterContract and theIEPto annuallyevaluatethe pupils (formallyand informally)to determineifthestudent is makingappropriate educational progress. As part oftheIEPreview process, eachLEA thatcontracts with aNPSshall evaluatetheplacement ofits pupil(s)in such aschool on at least an annualbasis. TheLEArepresentativeshall collaborativelyreview theNPSevaluation datatoensurethat the results areappropriate, reliable, and valid formeasuringpupil progress. TheLEA may determineto conduct theevaluation(s) and/or chooseto administer additional assessments with parent consent.
