Option To Lease Existing Space

The State is hereby granted the right from time to time during the term hereof to acquire additional office space adjacent to the leased premises subject to the following conditions:

A. Such right shall be exercised by a notice in writing from the State to Lessor made no less than days prior to the commencement of the term of any such additional space as specified in said notice.

B. Any such notice shall specify the new square feet of such space to be added to the lease. In no event will the amount specified be less than net usable square feet.

C. The aggregate space added to the lease during the lease term shall not exceed net usable square feet.

D. The additional monthly rental for such additional space shall be at the following rates:

(1) For occupancy prior to , $ per net usable square foot, and for the remaining term, $ per net usable square foot.

E. Upon the commencement of the term of any such additional space, the Lessor shall have altered and improved same at no cost to State so as to provide office space equal in utility and quality to the space herein leased. If plans and specifications for such alteration or improvement of equal utility and quality are furnished by State with the notice requesting such additional space, the Lessor shall alter and improve such space in accordance therewith.

F. The phrase "net usable square feet" shall mean the actual inside dimensions of those portions of said building furnished to State in accordance with the terms of this paragraph and shall not include public corridors, stair wells, elevators, and toilets.

G. Within days after the receipt of any such notice, Lessor shall give notice to the State as to Lessor's ability to supply the additional space. In the event Lessor is unable to supply such additional space, State, at any time thereafter, may terminate this lease upon giving notice to the Lessor at least days prior to the date when said termination shall become effective.
