Separation Agreement

Thank you for your years of service with Sample Church. This agreement defines the terms of separation from employment of (name here) from Sample Church.

  1. VOLUNTARY RESIGNATION: By signing this agreement you acknowledge that you are resigning completely voluntarily with no coercion.
  1. SEPARATION DATE: Per your letter of resignation your final date of employment will be (Separation Date here). You are expected to continue your employment obligations during this period and will receive your regular compensation and benefits through that date.
  1. SEVERANCE PAY: In consideration for signing this agreement and abiding by its terms, you will receive severance payments equivalent to (number) month(s) of compensation, less required tax withholdings, to be paid on the regular pay schedule.
  1. VACATION: Further, as part of your severance, you will receive your earned but unused vacation of (number) days, equal to ($X,XXX), less required tax withholdings, paid to you in full with your final Severance Payment.
  1. RETIREMENT CONTRIBUTIONS: You will receive employer matching retirement contributions only for the period through your Separation Date.
  1. HEALTH INSURANCE: You will continue to receive the employer paid portion of your health insurance premiums for a period of (number) months. Your benefits will cease on (date). If you choose you may apply for COBRA coverage for up to one year beyond that date paid at your own expense.
  1. LIFE/ADD/LTD INSURANCE: You will continue to receive employer-provided Life/ADD/LTD insurance for a period of (number) months ending on (date).
  1. REIMBURSABLE EXPENSES: You are to immediately submit the required documentation for any qualified business expenses already incurred. Effective immediately, you are not to incur any additional business expenses without the express consent of the Senior Pastor (or Personnel Committee Chairman or other named individual if pastor is leaving).
  1. MINISTRY EXPENSES: Effectively immediately, you are not to make any purchases or incur any ministry-related expenses without the express consent of the Senior Pastor or Church Administrator.
  1. RETURN OF PROPERTY: By the end of your Separation Date, you are to return to Sample Church any church property, including instruments, computers, laptops, musical instruments, credit cards, keys, documents, electronic documents, confidential information, or intellectual property in your possession.
  1. RELEASE OF RIGHTS: In consideration for and as a condition of the payments and benefits provided to you pursuant to this Agreement, you hereby completely release Sample Church, its staff, trustees, and members from any claims, liabilities, and obligations related to your employment, compensation, or separation from employment.
  1. DISPARAGEMENT: You agree not to knowingly disparage Sample Church, its staff, trustees, or members in any manner which may be harmful to the reputation of the church, its leaders, staff, or members. This restriction extends to statements made either publicly or privately, in written form or verbal, and includes email, social media, or other electronic media.
  1. CONFIDENTIALITY: You agree not to discuss any of the terms of this agreement or the circumstances of your resignation with anyone except legal or financial counsel for a period of five years.
  1. BREACH OF AGREEMENT: You acknowledge that any breach of the terms of this Agreement will result in the forfeiture of all severance pay and benefits and require the immediate return of any severance pay or benefits already received.
  1. NO DURESS: You acknowledge that you have been given adequate time to read and reflect on the terms of this Agreement and you enter into this Agreement voluntarily.

I acknowledge that I have read, understand and agree to the terms of this Agreement and that I enter into this agreement voluntarily.
