Thank you for your recent request received 30 January 2015 and actioned under the Freedom of Information Act 2000 (FOIA) in which you requested the following information:

Could I please request the information and data of all Registered HMO's throughout Liverpool, please?

I would like the actual address of the

  • Owners address
  • Licensed HMO address

RESPONSE:

I can confirm that Liverpool City Council unable to provide the requested information for the following reasons:

With regards to owners address, this information is considered exempt from disclosure under Sections 40(2)(b) and 40(3)(a)(i) of the Freedom of Information Act 2000 as this information is considered personal information. To clarify, this information is third party information and only accessible to the data subject.

The City Council has a duty to protect individual’s data and not disclose it to the world at large. The release of this information into the public domain would constitute an actionable breach of the Data Protection Act 1998, and therefore this information has been exempted.

In response to Licensing HMO address, the information which you have requested is already reasonably accessible to you by other means. To clarify, this information is published on the City Council website and you can access the latest report via the following link:

Section 21 of the FOIA states that public authorities do not have to provide information to applicants where it is reasonably accessible to an applicant by other means, therefore we are refusing to provide this information as you can already access it by accessing the link provided.

In accordance with the application of Section 40 and 21 of the Freedom of Information Act 2000 we have not provided all of the information you have requested. As such we are required to serve you with a section 17 notice. Please treat the following as such.

The City Council will consider appeals, referrals or complaints in respect of your request under the Freedom of Information Act 2000. However, these must be submitted in writing to within 28 days of receiving your response.

The matter will be dealt with by an officer who was not previously involved with the response and we will look to provide a response within 28 working days.

If you remain dissatisfied you may also apply to the Information Commissioner for a decision about whether the request for information has been dealt with in accordance with the Freedom of Information Act 2000.
