form 150i, foster parent affidavit of adopting foster child(ren) currently in home (instructions)

When DHS has received a voluntary surrender of parental rights or verified the filing of a petition to terminate parental rights on a child who has resided in the home of the Foster Parent(s) for sixty (60) days or more, a staffing shall be convened with the Foster Parent(s) to discuss the permanent placement plans for the child(ren). The staffing shall be held at a time when BOTH Foster Parent(s) (if applicable) can be present. The other participants shall include but not necessarily be limited to the child's case manager, the family’s case manager, the respective supervisors and a notary.

The child(ren)'s case manager shall complete the top part of the Form 150 prior to the staffing. At the time of the staffing, the child's case manager and the family's case manager shall present all information referenced by the bulleted items on the Form 150 to assist the Foster Parent(s) in making an informed decision regarding their interest in being considered to adopt the child(ren) in the home. It shall be clearly explained that no adoptive placement may be made unless the child(ren) becomes completely legally free and the Juvenile Court awards custody to DHS for the purpose of adoption. There shall be sufficient time allowed during the staffing for the foster parents to read each individual statement on the Form 150 and to ask for clarification or further information.

Following the discussion, the Form 150 shall then be signed by the Foster Parent(s), the child's worker, the supervisor and the notary. The original copy of the Form 150 will be placed in the child(ren)'s file and included in the child’s original Life History. An additional copy, along with the Post Adoption Services/Adoption Assistance Benefits Handout, is to be given to the Foster Parent(s) and a third copy provided for the family’s file.

At the conclusion of the staffing the Form 151, Foster Parent(s) Notification of Decision Regarding Interest in Adopting Foster Child(ren) shall be given to the Foster Parent(s) and the Foster Parents informed they have seven (7) calendar days to indicate their interest to the agency in being considered as the possible Adoptive Resource for the child(ren). A return envelope shall be provided or clear instructions as to the name and address to which it should be returned. It will be clearly explained that failure to return the form within the specified time frame will prompt the agency to take steps necessary to pursue another appropriate placement able to offer permanency to this child(ren).

FORM 150 IS NOT TO BE USED IN CASES WHERE A NON-SPECIAL NEEDS INFANT IS PLACED IN A FOSTER HOME ON THE BASIS OF A VOLUNTARY SURRENDER OF PARENTAL RIGHTS FOR THE PURPOSE OF ADOPTION.
