M E M O R A N D U M

TO: ALL LAW ENFORCEMENT AGENCIES

FROM: Sergeant Craig Carr

State Coordinator, 1033 Program

SUBJECT: WEAPONS ISSUE FORMAT

Governor Don Siegelman and Colonel James H. Alexander have approved the issuance of weapons under the Department of Defense 1033 Program. Listed are the requirements that must be met by the receiving agencies for these weapons.

Follow the format and answer all questions.

1. Give the number and type of weapons requested:

A.  M-14 rifle

B.  M-1911 .45 cal pistol

2. Agencies must explain in writing that they have read and understand the Bureau of Alcohol, Tobacco & Firearms’ requirements for receipt of weapons.

3. Requesting agencies must explain how the weapons will be used, stored and how qualified trainers for each weapon are available in the department for training.

4. Weapons will only be issued to full-time Post Certified officers.

5. Agencies must fill out the following Memo of Understanding with the Department of Public Safety prior to receipt of any weapons.

Weapons requested will be closely monitored to ensure the integrity of the program. All requests will be filled in the order that the requests are received. At no time will extra weapons be issued in anticipation of new hires.

MEMORANDUM OF UNDERSTANDING

BETWEEN

THE ALABAMA DEPARTMENT OF PUBLIC SAFETY

AND

(LAW ENFORCEMENT AGENCY)

This agreement is entered on this day ______, (Date) by and between the Alabama Department of Public Safety through Sergeant Craig J. Carr and (LEA) by and through (name of individual representing LEA).

WHERAS, the Alabama Department of Public Safety agrees to secure and issue excess military weapons under the Defense Authorization Act of 1997, Section 1033, and (LEA) wishes to secure for their use of weapons through this program. It is hereby agreed between the Department of Public Safety and (LEA) that in consideration of the securing and issuing of excess weapons by the Department of Public Safety that (LEA) does hereby agree to the following conditions for the issue and receipt of the weapons set out on the list that is hereto attached and made part of this agreement.

1.  To provide proof to the Alabama Department of Public Safety that

is a legitimate law enforcement agency within the state of Alabama.

2.  To provide a resolution of the governing body of (LEA) that (name of individual) is authorized on behalf of (LEA) to negotiate for and sign this agreement for receipt of the weapons listed hereon.

3.  That (LEA) and its governing body will indemnify, protect and save harmless the Alabama Department of Public Safety, the State of Alabama, its employees, successors in interest, agents of other persons from any and all claims, judgements, costs and expenses whatsoever arising on account of the securing and issuing of weapons set out herein.

4.  Provide proof to the Alabama Department of Public Safety that

has a certified trainer for the weapons that are being issued to the law enforcement agency and will not issue weapons to their officers until training is received.

5.  That agrees to provide certified training for its officers on the weapons within 60 days of the receiving them from the Department of Public Safety and certify to the Department the training of its officers in the use of the weapons herein listed.

6.  That will be solely responsible for the safety and storage of the weapons after they are issued and will indemnify and save harmless the Department of Public Safety from any claim, judgement, costs, of expenses arising out of the storage and safety of the weapons.

7.  agrees that no parts will be interchanged from these weapons to any other weapons, or the weapons that is issued; that if the weapons become nonfunctional they will be turned in as unserviceable in its entirety.

The undersigned agrees that this is a complete agreement between the parties and that each of them has authority to sign on behalf of the organization.
