Respected Sir,

I want to draw your kind attention regarding the matter of police inaction and harassment committed by the perpetrator police personnel of New Town Police Station, District-North 24 Parganas, West Bengal in the matter of alleged kidnapping andtrafficking of aminorgirlnamed Priya Roy (name changed) who is aged about 14 years only. New Town Police Station registered one criminal case in this matter on the basis of the written complaint filed by the victim’s family. But the police did not take any legal action to rescue the victimgirlin spite of the fact that already 100 days have passed since she remained untraced on and from 17.9.2015.It is revealed during the fact find that the parent of the victim knocked the door of New Town Police Station time after time since she went missing. But repeated requests made by the family members of the victim to take action had gone into the deaf ears of the police.Our attached fact finding report gives the details of the whole incident.

In the present case, the perpetrator police personnel violated some laws in the following ways: -

·  The perpetrator police personnel violated Articles 5 and 6 of UN Code of Conduct for Law Enforcement Officials.

·  The perpetrator police personnel violated the recommendations passed by the Committee of NHRC on missing of children.

·  The perpetrator police personnel violated the International Convention signed by India at New York on 9thday of May, 1950 for the prevention of immoral traffic.

·  The perpetrator police personnel are also guilty of not registering a First Information Report under section 370(Office-Trafficking) of Indian Penal Code [The Criminal Law (Amendment) Act, 2013] and under the relevant provisions of the Immoral Traffic (Prevention) Act.

Hence we seek your urgent intervention regarding this matter with the following demands:-

·  The whole incident must be investigated by the Commission’s own investigating wing.

·  Theminorvictimgirlmust be rescued immediately and appropriate legal action must be taken against the involved accused person in this incident.

·  The role of the perpetrator police personnel of New Town Police Station must be investigated neutrally regarding their alleged inaction and omission to discharge lawful duty in this matter and they must be booked under the law for their illegal acts.

Name of the victim:- Ms. Priya Roy (name changed) aged about- 14 years, residing at village – Ghoni(Ghoshpara), Police Station-New Town, District – North 24 Parganas, West Bengal, India.

Name of the perpetrators: - (1) The Inspector-in-Charge of New Town Police Station, District-North 24 Parganas; (2) The Additional Commissioner of Police, Bidhannagar Police Commissionerate, District-North 24 Parganas.

Date of incident:- On 17.09.2015 from 1 p.m. onwards

Fact Finding Details:-

It is revealed during the fact finding that the victim girl is only 14 years old (Date of birth-17.10.2001). She is a school going student reading in Class-IX at ‘Annada Sundari Balika Bidyapith’ school. Her father is a goldsmith and works in a jewelry shop. He earns about Rs. 7000/- per month.

On 17.09.2015 the victim girl left her house between 1:30 p.m. to 2 p.m. to take private tuitions. She had to attend two tuition classes that day and supposed to return back home between 8 p.m. and 8:30 p.m. but she did not return. Her family members went on search for her at every possible place but returned empty handed. On 18.09.2015 at 00.35 hours her mother went to New Town Police Station and lodged a written complaint. On the basis of the complaint, the police registered a criminal case vide New Town Police Station Case No 448/15 dated 18.09.2015 under sections 363/366A of Indian Penal Code.

On 1.10.2015, the mother of the victim girl again lodged a written complaint before the Additional Deputy Commissioner of Police, Airport Division Office under Bidhannagar Police Commissionerate, District-North 24 Parganas alleging that her daughter has been trafficked for immoral purpose to Bangladesh by one Mr. Bakul Gazi, son of Nur Islam Gazi. In the complaint she alleged that the said Mr. Bokul Gazi is a Bangladeshi national having residence at village-Gazipur, Police Station-Asasuni, District-Satkhira, Bangladesh. He used to work as a driver of cars owned by different car owners in the locality under Ghuni (Ghoshpara) village. Reportedly the said Mr. Bakul Gazi is involved in human trafficking.

The family of the victim girl alleged that the victim girl has not been rescued by the police till date and the police have been showing insensitive attitude by not taking proper action. The family members of the victim girl several times pleaded before the police of New Town Police Station to rescue the victimgirland take legal action against the accused person. But the police are not inclined to take any action. Instead the police asked the family of the victimgirlto gather information about her whereabouts and then inform the same to the police.
