Road Safety (Vehicles) (Registration Renewal) Regulations 2005

The Governor in Council makes the following Regulations:

1.Objectives

The objectives of these Regulations are to amend the Road Safety (Vehicles) Regulations 1999—

(a)to enable certain persons to pay vehicle registration fees at six monthly intervals; and

(b)to extend the concessions available to eligible beneficiaries and pensioners for registration fees; and

(c)to provide for related matters.

2.Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3.Commencement

These Regulations come into operation on 1January 2006.

4.Duration of registration

r. 4

(1)In regulation 219(1) of the Road Safety (Vehicles) Regulations 1999[1]—

(a)for "(3) and (4)"substitute "(3), (4), (5) and (6)"; and

(b)for paragraph (b) substitute—

"(b) in the case of a light vehicle or motor cycle—12 months; or

(c)in the case of a vehicle referred to in sub-regulation (5)—12 months or 6months.".

(2)After regulation 219(4) of the Road Safety (Vehicles) Regulations 1999 insert—

"(5)An applicant for registration of a vehicle referred to in—

(a)clause (4) of Schedule 4; or

(b)item 13, item 13A, item 13B or item 14 of the Table in Schedule 4—

may nominate a period of 6 months as the registration period for that vehicle.

Note:Regulation 236(2) provides for a pro rata fee in respect of registration for a period other than 12 months.

(6)Sub-regulation (5) applies even if the fee for registration in respect of the relevant vehicle is nil.".

5.Registration label

In regulation 223(2) of the Road Safety (Vehicles) Regulations 1999, for paragraph (e)substitute—

"(e) in the case of a heavy vehicle that is thesubject of a nomination under regulation219(3)—the start date; and".

6.Renewal of registration

After regulation 227(1) of the Road Safety (Vehicles) Regulations 1999 insert—

"(1A)An applicant for renewal of registration of a vehicle referred to in—

(a)clause (4) of Schedule 4; or

(b)item 13, item 13A, item 13B or item 14 of the Table in Schedule 4—

may nominate a period of 6 months as the period of renewed registration for that vehicle.

Note:Regulation 236(2) provides for a pro rata fee in respect of renewal of registration for a period other than 12 months.

(1B)Sub-regulation (1A) applies even if the fee for renewal of registration of the relevant vehicle is nil.".

7.Fees for registration and renewal of registration of other vehicles

In regulation 236(1) of the Road Safety (Vehicles) Regulations 1999, after "registration" (where secondly occurring) insert"for a period of 12months".

8.Amendments to Schedule 4—concessional registration fees for eligible beneficiaries or spouses or domestic partners

(1)In Schedule 4 to the Road Safety (Vehicles) Regulations 1999—

(a)in clause (1), for "The"substitute"Subject to clause (4), the";

(b)in clause (3), for "If"substitute"Subject to clause (4), if";

(c)item 11 of the Table is revoked.

(2)After clause (3) of Schedule 4 to the Road Safety (Vehicles) Regulations 1999 insert—

"(4) If a motor vehicle is not to be used except for social, domestic or pleasure purposes and—

(a)the motor vehicle is registered or to be registered in the name of a person who, at the commencement of the period of registration, is an eligible beneficiary or his or her spouse or domestic partner; and

(b)the provisions of this clause are not, at the commencement of the period of registration, being applied to—

(i) any other motor vehicle registered in the name of the applicant; or

(ii) if the applicant is not an eligible pensioner, any motor vehicle registered in the name of the applicant or the applicant's spouse or domestic partner—

the fee to be paid for registration or renewal of registration of the vehicle is 50% of the fee that would otherwise be payable under column 2 of the Table.".
