Visitor Export Control Agreement

(Non UH/RCUH Employees or Non-Students)

The University of Hawai’i (UH) system is subject to United States (US) export control laws and regulations that protect national security and trade which include, but is not limited to, the (1) International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120-130), implemented by the US Department of State; (2) Export Administration Regulations (EAR) (15 CFR Parts 770-774), implemented by the US Department of Commerce; and (3) Office of Foreign Asset Control Regulations (OFAC), which is part of the US Department of the Treasury, which is primarily responsible for administering and enforcing economic and trade sanctions against certain nations, entities, and individuals. In sum, these laws and regulations control the export of strategic information, technology, and services, to foreign countries, as well as to foreign nationals inside the US. Failure to comply with export control laws and regulations may lead to significant civil and/or criminal penalties including, but not limited to, monetary penalties up to $1,000,000.00 per violation; prison term up to 20 years; denial of export privileges; and debarment from US government contracts.

All UH visitors (meaning non-UH employees or students) mustabide by US laws and regulations, including those related to export controls. In order to prevent an inadvertent violationof US export controls, visitors are not permitted to participate in export-controlled activities without authorization from the UH Office of Export Controls (UH OEC). If such authorization is granted, it is explicitly noted below.

Part II: VISITOR AGREEMENT

Ihave read and understand this agreement, and what the UH has/has not authorized me to participate in.

If Box 1. Is checked on page 1, I understand that UH isnot granting me authorization to participate in any export-controlled activities and any of my actions contrary to export control laws and/or regulations are subject to civil or criminal penalties.

If Box 2. Is checked on page 1, I understand and acknowledge that UH is granting me authorization to participate in only the PSTCP shown above, under the direction of ______, a copy of which has been furnished to me on ______. I understand and acknowledge that UH is not authorizing any activities outside of the scope of the PSTCP, and further agree not to release any export-controlled information that is disclosed to me in any format (verbal, written, electronic) to any other persons or entities. I understand that any of my actions contrary to export control laws and/or regulations are subject to civil or criminal penalties.

Part III: UH PRINCIPAL INVESTIGATORAGREEMENT

Ihave read and understand this agreement, and what UH has/has not authorized the visitor to participate in. I will ensure the visitor is escorted through facilities with controlled technologies, and are not given keys/keycards, combinations, passwords or other access to research facilities in which export-controlled research is being preformed. I will check the visitor’s identity to make sure that the visitor has the same identity as the person identified as the visitor in this agreement.

If Box 1. Is checked on page 1, I will be responsible for ensuring that the visitor does not participate in export-controlled activities, and that technical data nor controlled equipment are present when the visitor is in the area.

If Box 2. Is checked on page 1, I will be responsible for ensuring that the visitor complies with the PSTCP identified on page 1.
