Whether the water court erred in finding that selective subordinations are permissible.

Whether the water court erred in failing to require that a request to approve and decree a selective subordination agreement between water users be submitted as either an application for the approval of a change of water right, a plan for augmentation and/or an appropiative right of exchange pursuant to § 37-92-302(1)(a), C.R.S. (2005).

Alternatively, if selective subordinations are permissible, whether the water court erred in finding that incorporation of a selective subordination in a decree does not require publication of a notice in the water court resume.

Whether the water court erred in providing for the incorporation of a selective subordination agreement into a water court decree when the agreement addresses after-acquired water rights not specifically identified in the agreement.

Whether the water court’s ruling is moot for the purposes of appeal because one of the parties voluntarily chose to abandon the challenged practice permitted by the ruling.
