‘Town of Carrabassett Valley Ordinance Regarding the Removal of Animal Waste’

(Pooper Scooper Ordinance)

Purpose: The purpose of this ordinance is to remove health, environmental concerns and a general nuisance caused by undisposed dog feces in specific condominium areas of Carrabassett Valley and the Town’s Narrow Gauge Pathway and associated Campbell Field Parking Lot.

Designated Area covered by this Ordinance: The area affected by this ordinance (“Area”) is the Narrow Gauge Pathway including the Campbell Field Parking Lot and the specific area within the Town’s ‘Planned Unit Development Zoning District’ described on the attached “Exhibit A” to include the following condominium properties in Carrabassett Valley:

Fall Line, Winters Way, Castle Creek, Snowbrook, Snowflower, Spruce Creek, Commons, Timberwind, Westwind, Sugartree I&2, Birchwoods 1-3, Black Bear, Sugarloaf Inn, Spaulding Court, Glade Court, Bigelow, Mountainside Phase 1 through VIII, Winterside, Walden, Wangan, Timbers at Bucksaw, Gondola Village, Village Center, Village West, Village South, Timberline and Mountain Center.

Removal of Animal Waste:

  1. No person shall fail to immediately remove and lawfully dispose of any feces left on any

property by a dog owned by, entrusted to or the responsibility of such person or under his/her control in any Area covered by this ordinance.

  1. This regulation shall not apply to a dog accompanying any handicapped person, who by reason of his/her handicap, is physically unable to comply with the requirements of this section. This regulation shall also not apply to a dog/owner when on property owned exclusively by the owner.

Enforcement: Any person who observes a violation of this ordinance may file a complaint with Town Police Department. The provisions of this ordinance may be enforced by the Town’s Animal Control Officer or any Police Officer appointed by the Town of Carrabassett Valley as a result of any such complaint, observing such violation or other evidence of such violation.

Penalties for Violation: Upon complaint before the District Court any person found violating any provisions of this ordinance shall be guilty of a civil violation and punishable by a fine of $50 for the first offense and $100 for each subsequent offense. All fines so assessed by the Court shall be recovered for use of the Town of Carrabassett Valley through District Court. Court proceedings may be waived by payment of such penalty to the Carrabassett Valley Police Department prior to any scheduled hearing before District Court.

Effective Date: The effective date of this ordinance shall be the following day after affirmative vote of the voters of Carrabassett Valley of this ordinance.
