RESOLUTION NO. 45-2014 (AMENDED)

A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH CAROL BINGGELI TO ORGANIZE AND RUN THE OLMSTED RECREATION YOUTH FLAG FOOTBALL PROGRAM FOR AN 8-WEEK PERIOD SPONSORED BY PARKS AND RECREATION AND OLMSTED RECREATION FOR THE 2014 SEASON AT A RATE NOT TO EXCEED $2,800.00 AND DECLARING AN EMERGENCY

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF OLMSTED FALLS, CUYAHOGA COUNTY, STATE OF OHIO, THAT:

SECTION 1. The Mayor is hereby authorized and directed to enter into a contract with Carol Binggeli to organize and run the Olmsted Youth Flag Football Program for the 2014 season at a cost not to exceed Two Thousand Eight Hundred Dollars ($2,800.00).

SECTION 2. The contract authorized herein shall be in a form substantially similar to the one attached hereto, marked Exhibit A and incorporated herein as if fully rewritten.

SECTION 3. All previous actions of Council and the Administration of the City regarding this authorization are hereby ratified and approved.

SECTION 4. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.

SECTION 5. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Olmsted Falls to organize and run the Flag Football program so that a coordinator is timely secured for the season of the 2014 Fall Recreation Program. It shall therefore take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.

EXHIBIT “A”

AGREEMENT

THIS AGREEMENT is made and entered into this day of ______, 2014 by and between the City of Olmsted Falls ("City"), an Ohio Municipal Corporation, and Carol Binggeli.

W I T N E S S E T H:

1. That the City agrees that Carol Binggeli shall be the Youth Flag Football Director for the 2014 Olmsted Recreation Fall Program.

2. That as Youth Flag Football Director, Carol Binggeli agrees to teach football fundamentals for participants for the City of Olmsted Falls under the supervision of the City’s Parks and Recreation Board.

3. That the City agrees to pay Carol Binggeli for the services referenced herein the sum not to exceed Two Thousand Eight Hundred Dollars ($2,800.00) at the completion of the contract (October 2014).

4. That the City of Olmsted Falls shall be reimbursed from registration funds once registration closes.

5. The residents of Olmsted Township and Olmsted Falls shall be charged the same amounts.
