104G-50.105 – AGENCY PERSONAL PROPERTY MANAGEMENT OFFICER

The Regional Property Management Officer (PMO) is responsible for obtaining all reports involving lost, stolen, damaged, or destroyed Government property and making determinations of apparent negligence. In order to fulfill this responsibility, the PMO needs to become familiar with instructions and procedures contained in FSM 5336, 6400, 6410, 6507, 6570, 6730, and Federal Property Management Regulations 104-50 and 104G-50.

104G-50.108 – PMO ACTIONS ON LOST, STOLEN, DAMAGED, OR DESTROYED PROPERTY

When the PMO receives Form AD-112 that indicates lost, stolen, damaged, or destroyed property:

1.  Both circumstances and evidence will be considered to determine if negligence or gross negligence appears to be involved.

2.  A signed copy of the AD-112 will be returned to the Forest Fleet Manager to include in the official fleet file.

3.  In the cases of apparent negligence:

a. The Regional PMO will refer the AD-112 and associated documentation to the employee’s supervisor, through the unit’s Line Officer, for consideration of disciplinary action.

b.  If the degree of negligence warrants disciplinary action, the supervisor will work with the Region’s Employee Relations Advisor.

c. If a determination is made that disciplinary action is not warranted, a justification statement will be included with the AD-112, signed, and dated by the supervisor.

d.  The AD-112 and supporting documentation will be retained by the supervisor; neither the Regional PMO nor the Forest Fleet Manager will receive a copy of the final determination.

4.  In the cases of apparent gross negligence:

a. The PMO will refer the AD-112 and associated documentation to the employee’s supervisor, through the unit’s Line Officer, for consideration of appropriate action under the Debt Collection Act.

b.  If a determination is made that fiscal liability is appropriate, the supervisor will work with the Region’s Employee Relations Advisor.

c. If a determination is made that disciplinary action is not warranted, a justification statement will be included with the AD-112, signed, and dated by the supervisor.

d.  The AD-112 and supporting documentation will be retained by the supervisor; neither the Regional PMO nor the Forest Fleet Manager will receive a copy of the final determination.
