If a member chooses to have a two bedroom rent ceiling apply, the rent ceiling that applies (in the above table) is reduced by 10 per cent.

Note: The effect of this is to apply the rates set out in Part 2 to the member.

1.3Rate if residence has more than three bedrooms

For a residence with four or more bedrooms, the rent ceiling (in the above table) is increased by 10 per cent for each additional bedroom.

Note: The above amounts are the ceilings applicable to an individual member, where there are four persons sharing a house, and are calculated by adding 10 per cent to the three-bedroom ceilings set out in Part 1, and dividing by four (see clause 1.3 of Part 1 of Annex 7.B). Where there are more than four occupants in a house, the appropriate ceiling for each member is calculated by adding 10 per cent for each bedroom to the relevant three bedroom ceiling, and dividing by the number of occupants. For example, where five occupants share a house, the ceiling would be the three-bedroom ceiling plus 20 per cent, divided by five.

EXPLANATORY STATEMENT

Defence Determination 2003/25

This Determination amends Defence Determination 2003/21, Conditions of Service (the Principal Determination), made under section 58B of the Defence Act 1903. Chapter7 of the Principal Determination sets out provisions dealing with housing rates and contributions for members of the Australian Defence Force (ADF).

The purpose of this Determination is to implement an annual review of members’ contribution rates and local allowance limits (‘rent ceilings’) for housing assistance and related purposes. (The previous review was implemented on 15 August 2002 by Defence Determination 2002/17.)

Clause 1 of this Determination sets out the manner in which this Determination may be cited.

Clause 2 of this Determination provides that the Determination commences on 11 September 2003. Members were administratively notified of the proposed changes on 1 August 2003.

Clause 3 specifies that the amendments are made to the Principal Determination, as amended.

Clause 4 increases the amount of assistance for the initial purchase of a home in specified circumstances. The increase of 3.8% is based on the movement of the relevant housing component of the Consumer Price Index (CPI) in the period since 1 July 2002.

Clauses 5, 6 and 9 set out the weekly contribution rates for utilities for members occupying temporary accommodation or living-in accommodation, and the weekly reimbursement limit for utilities for certain members who are entitled to a service residence or rent allowance. The amendments to these clauses increase the rates by 5.7%, 5.5% and 5.8% respectively, based on a 5.7% increase in the utilities subcomponent of the CPI from March 2002 to March 2003. The minor variations in the application of this CPI increase are due to rounding.

Clauses 7 and 12 implement revised allowance and contribution rates for meals. Most of these rates are set out in Annex 7.C to the Principal Determination. The increase of 3.9% in the rates takes into account the food component of the CPI from March 2002 to March 2003.

Clause 8 of the Principal Determination sets out the standard weekly contribution rate for water supplied to service residences. The amendment to clause 7.1.63 decreases the rate by $1.10 a week. This reduction reflects the decrease in consumption owing to water restrictions in force in many parts of Australia. This in turn has reduced the water charges paid by Defence to the Defence Housing Authority (DHA) during the review period.

Clause 10 implements revised member contributions for accommodation, which are set out in Annex 7.A to the Principal Determination as follows:

Part 1 of the Annex deals with the contribution rates for members occupying living-in
(ie mess or barracks) accommodation. The amendments to Part 1 increase the rates by between 4.8% and 13%, depending on the level of accommodation occupied. The increases are in line with the results of the annual review of the equivalent contribution for service residences. These charges are based on varying percentages of contributions for service residences, relevant to the rank of the member, the amenity of the accommodation occupied, and the member’s sharing arrangements. In addition, the contributions are being increased by annual increments to reach mature rates by July 2004.

Part 2 of the Annex deals with the contribution rates for living-in accommodation for members on leave without pay (other than part-time leave without pay). When members are on leave without pay they are not considered to be serving members of the Defence Force. As a result they are charged for living-in accommodation at rates that would be paid by Australian Public Service employees temporarily living in Defence accommodation. These rates have been increased by an average of 2.7%.

Part 3 of the Annex deals with contributions for service residences and rent allowance by members with dependants. The amendments to Part 3 increase the rates by approximately 4.7%. This percentage increase is based on 2 components. The first is a movement of approximately 2.7% in market rents for Defence housing in the preceding year, based on independent valuations. The second component of 2% is an instalment of the gradual phased-in variation of the contribution rates which aims to bring the net total of housing contributions up to 50% of the rental cost of Defence housing by July 2004.

Parts 4 to 7 of the Annex deal with the contributions payable by members without dependants when they are eligible for a service residence or rent allowance. The amendments to these Parts increase the rates by approximately 4.7%. The increases results from the gradual phase-in of incremental adjustments to achieve mature rates between July 1999 and July 2004. The mature rates will represent between 33.3% and 90% of the equivalent contribution for members with dependants. The changes made to the contribution rates since 1998 have continued to provide greater consistency between the accommodation entitlements of members with dependants and members without dependants, while ensuring that there is an incentive for members without dependents to share accommodation.

Clause 11 varies the local upper limits of Commonwealth assistance for privately rented dwellings (‘rent ceilings’) applicable to various classes of members and their accommodation arrangements, as appropriate. These rent ceilings are set out in Annex 7.B to the Principal Determination. Some remain unchanged, eg for members at Katherine and Rockhampton. Rent ceilings at other localities are increased by up to 13.6%, based on movements in average market rents for DHA properties at each locality. No rent ceilings have been reduced.
