Requirements for the power of attorney to be notarized outside Russia in order to obtain police clearance

  1. Issuance of power of attorney

ThepowerofattorneymustbeinconformitywiththegeneralrequirementsoftheRFlawswithregardtosuchdocuments, i.e.:

the power of attorneymusthavenoerasures, additions, crossed out words or other non-stipulated amendments;

if there are more than one page in the power of attorney, all pages must be stitched, numbered and sealed;

theissue dateof thepowerofattorney(the one at the top of the document) must be the same as the date of its notarization (the one at the bottom);

thepowerofattorneymadeina foreign language (whether in whole or in part) must be translated into Russian and such translation must be certified by a notary in the Russian Federation (you can order the translation in RS-CENTERseparately).

Consular legalization required

ThepowerofattorneynotarizedoutsidetheRFinacountrywhichisnotincludedintheforegoinglists,canbeacceptedbytheagenciesoftheRussianMinistryofInterior Affairs only if it has undergone consular legalization. The final stage in such legalization process is the certification in the Russian consulate of the relevant country.

Thepowerofattorneycanbelegalizedonlyin the country where it has been issued. For the avoidance of doubt, pleaseask the RF consulate or the competent authorities of the country where the power of attorney has been issued for clarification as to thelegalizationrequirements.

  1. Grantor

Either one individual or a group of individuals (two or more) can act as a grantor.

Whenaminororanindividualplacedunderguardianshipactsasagrantor, thepowerofattorneymustindicatethathe/sheis “actingupontheconsentofhis/herfather, mother, adoptiveparentorlegitimaterepresentative”. Insuchcasewerequirethatscanned copies (photocopies) ofthedocumentsattesting to the kinship, guardianship or adoption is made available to us.

  1. Attorney

Twoindividualsmentionedintheattached samplemustbespecifiedastheattorneyssoastoenableoneofthemtotakeall actions required in order to obtain police clearance in the absence of the other. Otherwise (whenonlyoneattorneyisspecified) the fulfillment of the instruction may require more time.

  1. Validity term

We recommend to specify the period of three months as the validity term of the power of attorney. Should yourequirethepoliceclearanceonregularbasis, you may have it issued for the period of three years and just phone us to order it without paying extra costs for legalization, dispatch or notarized translation.
