MEETING MINUTES

MONDAY

NOVEMBER 24, 2014

7:00 PM

A meeting of the Fort Kent Town Council convened at 7:03 pm. Present were Councilors John Bouchard, Anthony Gauvin, Priscilla Staples, Jacob Robichaud, and Peter Saucier. Members of the staff and public were Donald Guimond, Tony Theriault, and Daniel Nicolas.

1. MEETING MINUTES – 11-10-14

11-18-14:

A motion was made by Councilor Staples and seconded by Councilor Gauvin to approve the Meeting Minutes of November 10 and 18, 2014 as submitted. Motion carried, vote was unanimous.

2. WARRANTS – 11-12-14

11-18-14:

A motion was made by Councilor Saucier and seconded by Councilor Gauvin to approve the Warrants of November 12 and 18, 2014 as submitted. Motion carried, vote was unanimous.

3. YEAR TO DATE FINANCIALS - REVIEW:

The Council reviewed the Year to Date Financials with no action taken. With two months remaining in the budget year both revenue and expense budgets remain very tight. All departments need to remain diligent in order to insure that their respective budgets will end the fiscal year without overdrafts.

Expenses will need to be kept to the bare minimum and revenues will need to be maximized in order to insure a positive outcome.

4. 2015 BUDGET CALENDAR – REVIEW/APPROVAL:

A motion was made by Councilor Staples and seconded by Councilor Robichaud to approve the 2015 Budget Calendar (See appendix A). Motion carried, vote was unanimous.

5. MSAD 27 WARD 6 VACANCY:

A motion was made by Councilor Staples and seconded by Councilor Saucier to appoint Elaine Jandreau to fill the Ward 6 Vacancy until the March 2015 elections. Motion carried, vote was unanimous.

Appointment is subject to acceptance by the appointee.

6. NARAA - APPOINTMENT:

No action taken on this issue pending discussion with possible appointees.

7. SURPLUS PROPERTY BIDS – REVIEW/AWARD:

The following bids were received for the sale of Surplus Property:

1995 Johnston Sweeper

Town of Mars Hill $4,000.00

Richard Laplante 579.99

1982 GMC Snow Truck

Richard Laplante 259.67

1984 International Patch Truck

Richard Laplante 437.99

A motion was made by Councilor Gauvin and seconded by Councilor Saucier to award the Surplus Property Bid for the 1995 Johnson Sweeper to the Town of Mars Hill in the amount of $4,000.00 and to reject the bids for the 1982 GMC Snow Truck and the 1984 International Patch Truck. Motion carried, vote was unanimous.

A motion was made by Councilor Saucier and seconded by Councilor Staples to allocate the funds received from the Sale of Surplus property to the Public Works Capital/Equipment Reserve account and to utilize an amount not to exceed $6,000.00 from the reserve account to replace the leveling cables on the Bucket Truck in order to be compliant with safety regulations. Motion carried, vote was unanimous.

8. PERSONAL PROPERTY – DISCUSSION:

A motion was made by Councilor Gauvin and seconded by Councilor Staples to proceed with legal action against personal property account holders that are;

a. in arrears for two or more years

b. owe an aggregate amount of $200.00 or more

c. exceptions will be made on a case by case basis as it pertains to

accounts that are no longer in business

Motion carried, vote was unanimous.

Legal action may include, but is not limited to the small claims process.

9. PERSONNEL – RECREATION AND PARKS

POLICE CHIEF

RESERVE OFFICER [1 MRSA § 405 (6) (A)]:

A motion was made by Councilor Gauvin and seconded by Councilor Saucier to enter executive session to discuss the following Personnel issues, Recreation and Parks vacancy, Town Manger Contract, Non Union Employee Benefits/Adjustments, Bargaining Unit Negotiations, Police Chief probationary period, and Reserve Officer appointment as per 1 MRSA § 405 (6) (A). Motion carried, vote was unanimous. Entered executive session at 8:16 pm.

A motion was made by Councilor Robichaud and seconded by Councilor Saucier to exit executive session. Motion carried, vote was unanimous. Exited executive session at 9:16 pm.

Post executive session action.

Recreation and Parks Vacancy: A motion was made by Councilor Robichaud and seconded by Councilor Staples to appoint Dale Soucy to the vacant Recreation and Parks position on the agreed upon terms and conditions subject to the probationary period. Motion carried, vote was unanimous.

Town Manager Contract: No action taken.

Non Union Employee Benefits/Adjustments: No action taken.

Bargaining Unit Negotiations: Contract Negotiations will continue on December 09, 2014 at 5:00 pm.

Police Chief: A motion was made by Councilor Gauvin and seconded by Councilor Robichaud to adjust the Police Chief salary by $1,000.00 upon satisfactory completion of the probationary period. Motion carried, vote was unanimous.

Reserve Officer: A motion was made by Councilor Saucier and seconded by Councilor Staples to appoint Curtis Picard as a Reserve Officer subject to the probationary period. Motion carried, vote was unanimous.

A motion was made by Councilor Staples and seconded by Councilor Robichaud to

adjourn. Motion carried, vote was unanimous. The Council meeting adjourned at 9:25

pm.
