Planning Commission

Planning Commission present: Chairman Joe Stubbs, Vice Chairman Nancy Baird, Commissioner John Rosenberger, and Commissioner Brian Ewell. Legal Counsel Josh Nielsen and Clerk Lucinda Daley.

Residents Present: Dale Steele, Mandy Hockersmith, William McMullin, Adam Peterson, Coby Jones, Thad Rowley, Bryan Draper, and DeeAnn Thomas.

Opening Prayer by Lucinda Daley.

Pledge of Allegiance led by William McMullin.

Public Hearing

Brian Ewell made a motion to open Public Hearing for rezoning of addresses 491 S. 800 E. and 1000 E. 750 S. from A-1 Agricultural to R-1 Residential.

Seconded by Ron Hawkins

No Comments. No Questions from the public.

Nancy Baird made a motion to close Public Hearing due to lack of comment.

Seconded by Brian Ewell.

Vote was Unanimous.

Discussion and possible action on a building permit for a barn on property owned by Coby Jones located at approximately 1552 N Main. Chairman Stubbs asked if there were any buildings on the adjoining properties that would be within 50 feet. No buildings are located within 50 feet of the proposed barn.

Chairman Joe Stubbs made motion to approve Coby Jones barn located at 1552 N Main.

Ron Hawkins Seconded motion.

All voted in favor.

Next Agenda item building permit for shop on property owned by Gaven Johnson located at 583 E 1200 N. There was discussion on what measurements are showing on the plot map and all measurements need to be clearly labeled and defined.

Brian Ewell made motion to approve building permit for Gaven Johnson with contingency of showing measurements for setbacks from the house and adjacent property lines to the east.

Joe Stubbs seconded motion.

Vote was unanimous.

Discussion and possible action on a building permit for a storage building on property owned by Adam Peterson located at approximately 1727 N 150 W. Discussion on structures on adjoining properties and measurements to property lines with adjacent buildings. There is only 6 feet from the proposed storage building to property line. Commissioner Ewell looked up building ordinance regarding adjacent buildings. It was determined that it was not required to show adjacent buildings owned by adjoining property owners.

Joe Stubbs made a motion to approve building permit for storage building on property owned by Adam Peterson located at 1727 N. 150 W.

Nancy Baird seconded motion
All voted in favor.

Dale Steele Rezone from A-1 Agricultural to R-1 Residential on property located at approximately 491 S. 800 E. There were no concerns regarding the zone change.

Joe Stubbs made motion that we recommend to the Town Council that we are in favor of zone change.

Brian Ewell seconded that motion.

All voted in favor.

Dale Steele Subdivision Agenda Item on property located at 491 S. 800 E.

The Planning Commission reviewed the subdivision engineered drawings according to the Genola Town Subdivision Ordinance Checklist. Discussion on whether it is required to show drainage on the plat map. Legal Counsel stated that the planning commission can use their discretion per case. It was decided that drainage was not necessary on this particular subdivision.

Joe Stubbs made a motion to approve the Subdivision Plat with the contingencies that the measurement to the fire hydrant be shown, make sure secondary water meter is in place on new lot, list of 7 contingency items

John Rosenberger seconded motion.

All in favor.

Discussion and possible action on a building permit for a modular home on property owned by McMullin Orchards (William McMullin) located at approximately 1117 E 400 N.

Joe Stubbs made motion to approve building permit for modular home with the contingency that the health department signs off on septic and that the existing home be torn down within 60 days of new modular being put onto property.

Brian Ewell seconded motion.

All unanimously in favor.

Discussion on property owned by Thad Rowley A-1 Agricultural to R-1 Residential rezone for property located at approximately 1000 E. 750 S. There were no concerns stated by the commission regarding this rezone.

Joe Stubbs made a motion to recommend to Town Council that a rezone permit be approved.

John Rosenberger seconded motion.

Discussion on drafting a new ordinance regarding division of cost for added infrastructure.

Commissioner Brian Ewell reported on comparable cities; Midway, Mapleton, Elk Ridge, and Spanish Fork, with ordinances related to reimbursing developers for adding development. Chairman Joe Stubbs liked the idea of Mapleton’s ordinance putting the reimbursement process onto the developer. To get reimbursement the city had to approve it. They leave it upon the developer to come up with the reimbursement plan because each situation is different. Mapleton has a five year reimbursement plan, after the stated time period no additional reimbursements can be submitted for that infrastructure. All discussed cities had a five year reimbursement expiration. Chairman Stubbs suggested that the Council just limit their discussion to what was liked or not liked about the ordinances from the comparable cities. Chairman Stubbs wanted to speak with The Town Council and see how committed they were to getting this ordinance set up before The Planning Commission went through the whole process of getting a new ordinance generated.

Discussion on amending ordinance to show that the 170’ of frontage must be contiguous. Chairman Joe Stubbs stated that he had always understood it to be that contiguous frontage to be assumed but Councilman John Rosenberger wants to take the word assume out of the discussion. It needs to be spelled out in black and white. Legal Counsel Josh Nielsen asked what The Planning Commission wanted to be approved for building lots going forward. Chairman Stubbs said that as long as we are consistent going forward then that is what should be approved. Contiguous frontage or both sides used for frontage on a corner lot. Planning Commission discussed on if they wanted the same contiguous frontage to be applied to all the zoning (residential, agriculture).

Discussion on implementing a SWPPP. John Rosenberger would rather wait until next month where there would be more chairman present.

John Rosenberger made a motion to table SWPPP until June meeting.
