1. This permit is for a church located at 6707 Camden St. The property is in the R-55 Zone. The total lot size per the submitted site plan is 15,238 square feet or 0.3498 acres. Churches located on a lot less than 1 acre in size requires Special Exception Approval in the R-55 Zone. However, permit 326-85-CGU/02 was approved and issued for New Jerusalem Baptist Church 28 seats. If the church was in operation at the time CB-23-1993 and has been in continuous operation without ceasing operation for more than 180 days from 8/31/93, to the present date, the church could pursue certification of nonconforming use. According the submitted site plan the proposed church is requesting 100 seats. The number of seats that were legally existing per prior permit 326-85-CGU/02 can only be certified. If the applicant is proposing 100 seats a Special Exception approval would be required. 8/21/17 – Ok per full certified nonconforming use.

8/8/17 – Additional comments per submitted NCU Package:
1. Signature of the owner of the property is required on the NCU Application. 8/9/17 – Applicant signature is the same as owner signature. I noted this on application.
2. The zoning sketch map submitted indicates the outlined property owned by New Jerusalem Baptist Church is located on Lots 1 through 6. The certification of nonconforming use for the church will only include lots 1 through 3 which was approved per prior permit 326-85-CGU/02. Any alterations/extensions/additions to this property will require Special Exception Approval. 8/9/17 – Discussed with Robin Floyd.
3. The documentation submitted includes Personal Property Return from 1994 through 1999. This documentation is for New Jerusalem Baptist Church located at 2218 Columbia Pl. Landover. Documentation indicating the current location must be submitted. Also, documentation of continuous operation must be from 1993 to the present. Documentation from 2000 to the present has not be submitted. 8/9/17 – Per my discussion with Robin Floyd the documentation from 1994 through 1999 for New Jerusalem Baptist Church located at 2218 Columbia Pl. Landover is the corporate office address. The letter from Pastor Miller indicating operation from February 7, 2000 through June 9, 2017 is not adequate documentation of continuous operation per Section 27-471(c) Continuous, day-to-day operation of a certified nonconforming use is required to maintain its nonconforming status. Discontinuance of day-to-day operation for a period of one hundred eighty (180) or more consecutive calendar days shall constitute abandonment of the use. 8/21/17 Ok per documentation.
