RE: CERTIFICATE OF APPROVAL UNDER THE

PROVISIONS OF BETHLEHEM ORDINANCE NO.

721 AND AS AMENDED.

WHEREAS, it is proposed to place a “hotdog cart” on the sidewalk in front of

15 W. 4th St.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bethlehem that a “Certificate of Approval” is hereby granted for the street vendor cart and operation; and

BE IT FURTHER RESOLVED that City Council approves the request to have signage on the umbrella limited to “Sabrett”; and

BE IT FURTHER RESOLVED that the hours of operation shall be reviewed and subject to further Certificate of Approval by City Council.

STREET VENDOR AND STREET FURNITURE COMMITTEE

CASE # 001– It is proposed to place a “hotdog cart” on the sidewalk in front of 15 W. 4th St. OWNER/APPLICANT: 4th St. Club Entertainment LP/ Christopher Morales

The Committee upon motion by Mr. Evans and seconded by Ms. Heitmann adopted the proposal that City Council issue a “Certificate of Approval” for the proposed street vendor cart and business described herein:

1.  The proposal to place a “hotdog cart” on the sidewalk in front of 15 W. 4th St. was presented by Christopher Morales.

2.  The hours of operation will be Monday-Saturday 11am-4pm and Friday, Saturday, and Sunday early morning from 12am-2:30 am. The Committee decided the early morning hours were appropriate for this proposed location in South Bethlehem because of the active late night/early morning “night life”. It was the Committee’s opinion that the presence of the street vendor on the street would contribute to safety.

3.  The cart will be a stainless steel cart and measure 40” wide x 40” long not including the propane tank and tow bar. The cart will have two push handle bars, fenders, and an umbrella.

4.  Because Ordinance 721 restricts signage to the name of the business and because the applicant did not have a photograph of or the material for the proposed umbrella, the Committee did not approve the umbrella. The Committee did give the applicant approval to use the red and white umbrella in the photographs submitted for 30 days only.

5.  The applicant will show the proposed umbrella to the Committee Consultant for assistance and guidance on its conformity to the Street Vendor Design Standards. City Council must rule on the request to have signage on the umbrella since it is not permitted in the Ordinance.

6.  The business sign will be installed on the cart as proposed. The sign will be as shown in the rendering submitted to the Committee.

7.  The hitch will be protected with a rigid boxlike cover. A simple painted plywood box would be acceptable.

8.  The menu will be as proposed: hotdogs, hamburgers, wraps, sausage, shish kabob, A-treat sodas, water, and juice.

9.  The proposed street vendor cart and operation was approved by a unanimous vote.

WHEREAS, it is proposed to place a “hotdog cart” on the sidewalk in front of

15 W. 4th St.; and

WHEREAS, in Resolution 2010-98 adopted July 6, 2010 it is stated that the hours of operation shall be reviewed and subject to further Certificate of Approval by City Council.

NOW, THEREFORE, BE IT RESOLVED that the hours of operation shall be Monday-Saturday from 11:00 a.m. to 4:00 p.m.; and Friday, Saturday, and Sunday from 12:00 a.m. to

2:30 a.m.
