1.2CONTRACT PERIOD

This Locally Enhanced Service Contract (LESC) takes effect from 1st April 2015 to 31stMarch 2016

1.3NOTICE OF TERMINATION

Either party may terminate this contract by providing three months written notice or by a mutually agreed date confirmed in writing by both parties.

NHS England Hertfordshire & South Midlands Area Team may suspend or terminate this agreement forthwith if there are reasonable grounds for concern, including but not limited to malpractice, negligence, or fraud on the part of the pharmacy.

1.4CONTRACT REVIEW

1.4.1NHS England (Central Midlands) and the Community Pharmacy in consultation with the Community Pharmacy Contract Manager will review the content of the contract and the performance against the contract to inform and agree any changes to service requirements.

1.4.2This contract may be amended to reflect updated Department of Health guidance on locally enhanced Primary Care services.

1.4.3Both parties must agree any changes to this agreement in writing via a contract variation.

1.5OBLIGATIONS

The pharmacy will provide the service in accordance with the specification (Schedule 1)

NHS England (Central Midlands) will manage the service in accordance with the specification (Schedule 1).

1.6STANDARDS

The service will be provided in accordance with the standards detailed in the specification (Schedule 1).

1.7CONFIDENTIALITY

Both parties shall adhere to the requirements of the Data Protection Act 1988 and the Freedom of Information Act 2000.

Any approaches by the media for comments or interviews must be referred to NHS England (Central Midlands).

1.8INDEMNITY

The pharmacy shall maintain adequate insurance for public liability and professional indemnity against all claims which may arise out of terms and conditions of the agreement.

Any litigation resulting from accident or negligence on behalf of the pharmacy is the responsibility of the pharmacy who will meet the costs and any claims for compensation, at no cost to NHS England.

Schedule 1

SECTION 1: SERVICE SPECIFICATION

AIMS OF THE LOCALLY ENHANCED SERVICE

All pharmacies are expected to provide Essential Services and those additional enhanced services that they are contracted to provide to their patients.

This Locally Enhanced Service specification outlines the service for the provision and maintenance of stocks of drugs for use in Palliative Carefor supply against an NHS prescription presented to the pharmacy.

The specification is designed to cover the locally enhanced aspects of clinical care of the patient, all of which are beyond the scope of essential services.

SERVICE TO BE PROVIDED BY THE PHARMACY

Service Provider = Pharmacist

The pharmacy shall

a)Purchase and maintain the required stock (range and quantity) of palliative care drugs according to the agreed list which will be reviewed annually (appendix A).

b)Dispense the items from the palliative care drug stock in response to NHS prescriptions presented to the pharmacy in line with the dispensing service of the NHS Community Pharmacy Contract.

c)Maintain records of all drugs supplied (appendix B) in order to monitor and audit service delivery.

d)When dispensed the pharmacy shall replenish stocks at the earliest opportunity

e)Monitor the expiry date of these drugs and ensure that those reaching the expiry date are replaced. The pharmacy may claim for reimbursement, at cost, of date expired drugs from the approved list, provided stock rotation procedures have been followed.

f)Submit returns quarterly to NHS England (Central Midlands)to claim reimbursement payments for any date expired drugs.

g)In circumstances where the pharmacy is unable to supply an item on demand, they will signpost the patient/carer/healthcare professional to the nearest pharmacy provider of palliative care stock drugs (appendix C), checking first that they have the supply in stock.

h)Refer any concerns which cannot easily be dealt with, to the Area team

i)Provide the NHS England (Central Midlands) with such information as may be required to monitor the uptake and costs of the service.

1.1SERVICES TO BE PROVIDED BY THE NENE AND CORBY CCG PRESCRIBING POLICY AND PHARMACY SERVICE

To support pharmacies to provide the service, NHS Nene and NHS Corby’s Prescribing and Medicines Management Team will provide the following:

a)Up to date list of drugs to be held

b)Support to pharmacies with advice if requested.

SECTION 2: PAYMENT MECHANISM

2.1Each Pharmacy contracted to provide this service will receive an annual retainer fee of £100 at the start of each annual period.

The NHS England (Central Midlands) will reimburse the pharmacy for drug costs (at Drug Tariff prices) on receipt of the attached claim form (appendix ), for medicines included in the Nene CCG and Corby CCGPalliative Care Stock List which are date expired, provided normal stock rotation procedure has been followed and broken bulk has not been claimed

2.2Payment will be made on receipt of a signed contract and invoice claim form for remuneration of drug costs

2.3 Payment will be made as a local enhanced service through the PPD system

SECTION 3: PERFORMANCE MANAGEMENT

3.1ACTIVITY FOR SUBMISSION TO THE NHS England (Central Midlands)

As detailed in Section 1.2:

  • Payment for the service will be made on return of the signedLocal Enhanced Service contract.
  • Claims for date expired stock should be made on the claim form (appendix D)which should be returned as stock is replaced.

3.2SUPPORTING EVIDENCE

Pharmacies will be required to provide an audit trail for supplies issued to demonstrate implementation of quality standards, including, appropriate supply and recording.
