The following Copyright Transfer becomes effective only after the paper is accepted for publication in Scientific Bulletin of Naval Academy
In consideration of the review and/or editing, a registered charity (the “Society”) of the material submitted for publication entitled
(the“Work”) by the undersigned one or more person(s) (the “Author(s)”), the Author(s) agree to the following terms (the “Agreement”):
1. In consideration of the Society publishing the Work, The Author(s) exclusively assign to the Society with full title guarantee in all media (whether existing now or in the future) all copyrights and all rights in the nature of copyrights in the Work arising under the laws of any jurisdiction (whether vested, contingent or future) throughout the world for the residue of the term of copyright and such rights therein including, but not limited to, all translations, revivals, renewals and extensions of such rights together with the right to sell and exploit the Work.
2. The Author(s) unconditionally and irrevocably waive such moral rights as are conferred by Chapter IV of Part I of the Copyright Designs and Patents Act 1988 or other laws in force from time to time in any part of the world which may confer analogous rights.
3. The Author(s) transfer to the Society all lending and rental rights in connection with the Work and the Author(s) irrevocably confirm that the consideration given to the Author(s) hereunder shall be deemed to include equitable remuneration for the right to exploit all rental rights.
4. The Author(s) hereby also grant permission to the Society to use such Author(s)’s name(s) and likeness(es) in connection with any past, present or future promotional activity by the Society, including, but not limited to, promotions for upcoming issues or publications, circulation solicitations, advertising or other publications in connection with the Society.
5. The Author(s) warrant to the Society that:
(a) he/she/they have taken a significant and active part in the preparation of the Work and has read and approved the final version of it;
(b) he/she/they are willing and able to discuss the Work in detail should it be so required;
(c) he/she/they have provided one copy of any and all parallel or related submitted or published manuscripts in respect of the Work;
(d) he/she/they have the right to assign to the Society the rights in the Work asset out in this Agreement;
(e) the Work is original;
(f) no exploitation of the rights in the Work assigned to the Society under this Agreement will infringe upon the rights of any third party nor create any other liability for the Society nor be otherwise unlawful; and
(g) the Work has not been previously published nor is it under consideration by any other journal or publication.
6. The Author(s) agree to indemnify the Society and any of its officers, employees and agents from and against all and any expenses, losses, liabilities, damages, costs or expenses (including legal costs) whether or not reasonably or otherwise foreseeable or avoidable incurred or suffered by the Society and any claims or legal proceedings which are brought or threatened arising from any breach of this Agreement or otherwise caused by the publication of the Work by the Society. In the case of more than one Author, this responsibility is join and several.
7. Nothing in this Agreement shall constitute any promise by or obligation of the Society to publish the Work, or any portions of it. In no event shall the Society have any obligation to return to the Author(s) the manuscript or any other copy(is) or embodiment(s) of the work delivered to the Society by the Author(s) or made by the Society.
8. This Agreement constitutes the entire agreement between the parties and supersedes any previous agreement, arrangement or understanding (oral or written) relating to its subject matter.
9. This Agreements shall be governed by and construed in accordance with laws of Romania and Wales and the parties submit to the non-exclusive jurisdiction of the law.
