ABSENT: David Gengozian

Mr. Craft made a motion that the minutes of the meeting held October 13, 2009 be approved as submitted. Mr. Adams seconded the motion. Motion carried, Ms. Donnelly abstaining.

The following cases were reviewed:

Case No. 09-09

Aaron Wells, Wheel 2 Wheel, 178 Oak Ridge Turnpike, Lot 220.04, Block 17 CL, in a UB-2 zoning district is requesting a special exception to allow outdoor storage at this location.

Ms. Donnelly made a motion that the requested special exception be approved under sections 16.10(b) and 7.04 (c) . Mr. Craft seconded the motion. Motion carried unanimously to grant the special exception to allow outdoor storage of vehicles with the following conditions:

·  The applicant provide City staff with a site plan to determine compliance with all applicable minimum site requirements

·  The chain link fence be screened by evergreen plantings (a minimum of 24 – 36 inches at planting) along the entire side and front lengths of such fence so that the storage of such vehicles is not visible from the Oak Ridge Turnpike

·  That all vehicles stored must be operable, registered vehicles

·  That vehicles cannot be stored for the purpose of obtaining parts

·  That the storage of junk inoperable vehicles be prohibited

·  That the existing required buffer between the business and adjacent residential property not be compromised with the addition of the fence

·  No outdoor storage shall be allowed outside of the fenced area

·  The applicant has 60 days to submit the site plan and all necessary paperwork for the building permit for the fence

Case No. 09-10

City of Oak Ridge, Elza Gate Park Parking Lot, Oak Ridge Turnpike, Lot 320, Block 17 CN, in a RG-1 zoning district is requesting a variance to reduce the buffer strip requirement for off-street parking lots directly across the street from any residential zoning district.

Ms. Donnelly made a motion that the requested variance be approved under sections 16.10(c) and 11.03(g)2. Mr. Craft seconded the motion. Motion carried unanimously to reduce the front buffer requirement from 20 feet to 10 feet per Section 11.03(g).

Case No. 09-11

Cory Trotter, D&N Electric Company, 313 Oak Ridge Turnpike, Lot 250.02, Block 17 CK, in a UB-2 zoning district is requesting a special exception to allow for outdoor storage at this location.

Mr. Adams made a motion that the requested special exception be approved under sections 16.10(b) and 7.04(c). Mr. Craft seconded the motion. Motion carried unanimously to allow for outdoor storage at this location, with the following conditions:

·  The applicant provide City staff with a site plan to determine compliance with all applicable minimum site requirements

·  The fence be a minimum of six (6) feet in height

·  The perimeter of the fence be screened by evergreen plants (a minimum of 24 – 36 inches at planting) so that the outdoor storage area is not visible from any streets

·  The outdoor storage area is for supplies and equipment associated with the business only and is not used for the storage of vehicles

·  No outdoor storage shall be allowed outside of the fenced area

Case No. 09-12

Chris Etters, Claiborne Hauling Contractors, LLC, Commerce Park Drive, Lot 6, Block 27 CD, in a IND-2 zoning district requesting a variance to allow for a grading permit on a lot that exceeds 10 acres without submitting a site plan.

Chris Etters, representative of Claiborne Hauling, was present and addressed the Board. He reviewed the letter sent by staff dated November 10, 2009. After expressing disagreement with the bond amounts and the restrictions on the destination of the excavated dirt, he requested that the case by postponed until the January 12, 2010 meeting.

Per applicant’s request, case was postponed until January 12, 2010.

On a motion by Mr. Craft, seconded by Ms. Donnelly, the meeting was adjourned at 8:10 p.m.
