1.National legislation refers to the Environment Protection Act (Act I of 2016) and all relevant subsidiary regulations namely: the Flora, Fauna and Natural Habitats Protection Regulations, 2006 (Legal Notice 311 of 2006, as amended), including the Reptiles (Protection) Regulations, 1992 (Legal Notice 76 of 1992), the Marine Mammals Protection Regulations, 2003 (Legal Notice 203 of 2003) and the Flora, Fauna and Natural Habitats Protection Regulations, 2006(Legal Notice 311 of 2006, as amended). This application does not include consent in conjunction with CITES.

In the case of access from privately owned land, permission will need to be sought from the owner/s. Please specify whether this has been obtained and attach copy of permission.

7 / How will be the site be accessed? Provide details of the motor vehicles to be used [e.g. dinghy, car, helicopter, etc.] and how you will reach other parts of the area [e.g. abseiling, walking, diving, etc.].
8 / Description of the method to be used for the project
Description should also include mode of capture, handling, transport and/or keeping, if applicable. The number of specimens to be collected, clearly justifying the taking, should also be included, even if estimates. In case of sampling from dead specimens, please indicate what sampling tissues or organs are needed for such scientific studies and the number of samples. Please note that in the case that samples are sent abroad, full justification, a detailed route and the addressee should be provided. If covered by CITES, another permit may be required.

4. Additional Information
4.1 Indicate whether the application corresponds to any of the following criteria (tick as appropriate):
  • has already been proposed in an application for a permit clearance or licence made under the Environment Protection Act or the Development Planning Act, which is still being processed, amended, reconsidered or appealed in accordance with any of the aforementioned Acts;

  • Would prejudice the merits of such processing, reconsideration or appeal;

  • Would prejudice the merits of a request for any clearance or licence required by the aforementioned Acts, or would prejudice the merits of an appeal from a decision thereon;

  • Would prejudice any enforcement case, court case or other cases currently sub-judice.

  • For specimens of the species listed in Schedule V (a) of the Flora, Fauna and Natural Habitats Protection Regulations, 2006 (L.N. 311 of 2006), there is no satisfactory alternative.

  • For specimens of the species listed in Schedule V (a) of the Flora, Fauna and Natural Habitats Protection Regulations, 2006 (L.N. 311 of 2006), the application is for one of the following purposes:

  • In the interest of protecting wild fauna and flora and conserving natural habitats;

  • To prevent serious damage, in particular to crops, livestock, forests, fisheries and water and other types of property;

  • In the interests of public health and public safety, or for other imperative reasons of overriding public interest, including those of a social or economic nature and beneficial consequences of primary importance for the environment;

  • For the purpose of research and education, of re-populating and re-introducing these species and for the breeding operations necessary for these purposes, including the artificial propagation of plants;

  • To allow under strictly supervised conditions, on a selective basis and to a limited extent, the taking or keeping of certain specimens of species listed in Schedules IV(a) and V(a) to these regulations in a limited numbers specified by ERA.
