ELY SPACE RENTAL AGREEMENT

1. The parties to this contract are Westfield State University Campus Center hereafter called LESSOR and (Name) hereafter called LESSEE.

2. The purpose of this contract is to set forth the terms that constitute the rental of floor space in the Ely Building Main Lobby between the hours of and on: (date/s)

3. If by any reason or cause whatsoever beyond the control of the Lessor the rental premises cannot be used, the LESSOR shall not be liable for expense or losses incurred by the LESSEE; however, an alternative date may be set by mutual consent of parties.

4. LESSOR agrees to arrange for the premises to be accessible to LESSEE one hour prior to the rental period for setup purposes.

5. LESSEE agrees to utilize the rental space for the specific purpose of: and pay $25 a day for the rental space. If more than two tables are used you will provide the third table and pay $40. Check shall be made payable to the WSU Campus Center and mailed to Westfield State University, 577 Western Ave, Westfield, MA 01086 ATTN: Maureen Halloran.

6. LESSEE agrees to use the premises solely for the above-stated purposes(s) and will occupy the premises only during the time specified above and for reasonable time thereafter for restoring the rental space to its original condition. Any item that expresses or implies approval of or tends to glamorize alcoholic beverages or illegal drugs shall not be displayed or made available for sale at Westfield State University. No flammable products shall be sold on LESSOR’s property including candles, incense and cigarettes. LESSEE also agrees not promote, solicit or distribute any materials pertaining to the application of credit cards or similar credit applications on LESSOR’S property.

7. Pursuant to the copyright Act of 1976, Title 17 of USC Public Law 940553 (90 Stat 2451), LESSEE expressly agrees to comply with all provisions thereof as stated on the reverse side.

8. LESSEE certifies that he/she holds a valid Massachusetts Tax No. issued by the Commissioner of Revenue pursuant to Chapter 14, Act 1966, Section 1, Subsection 7, or General Laws, Chapter 6411, Section 7; or a valid Federal Identification No. as specified below.

266:143. Unauthorized Reproduction, Transfer, Sale, etc. of Sound Recordings; Penalty.

Section 143 Whoever directly or indirectly by any means, shall knowingly transfer or cause to be transferred any sounds recorded on a phonograph record, disc, wire, tape, film or other article on which sounds are recorded, with intent to sell, or cause to be sold, or to use or cause to be used for profit through public performance, such article on which such sounds are so transferred without consent of the owner, or whoever sells any such article with the knowledge that the sounds thereon have been so transferred thereon without the consent of the owner shall be punished by a fine of not more than five thousand dollars or by imprisonment for not more than one year. For the purpose of this section the word “owner” shall mean the person who owns the master phonograph record, master disc, master tape, master film or other device used for reproducing recorded sounds on a phonograph records, discs, tapes, films or other articles on which sound is recorded, and from which the transferred recorded sounds are directly or indirectly derived, provided that nothing contained in this section shall be construed to apply to any person lawfully entitled to use or cause to be used such sounds for profit through public performance, who transfers or causes to be transferred any such sounds as part of a radio or television broadcast or for archival preservation.

The copyright law provides two levels of copyright protection for music. The original composition, and each new arrangement, is eligible for separate copyright protection. Furthermore, each recorded performance is eligible for separate copyright protection.
