A regular meeting of the Minnewaukan City Council was called to order on December 6, 2011 by Acting Mayor Mark Motis at 5:50 pm in the City Library. Also present were Council Members Rita Staloch and Jean Callahan, Auditor Debra Trnka, Flood Project Manager Sherri Thompson, Librarian Cathy Burkhardsmeier, County Commissioner Jason Lee, Erik Gilbertson, Mark Olson, Allan Nord, Joanna Potts, and Dale Robbins.

Approve Agenda

Motion by Staloch to approve the agenda. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

Approve Minutes

Motion by Callahan to approve the minutes from November 8, 2011 and November 29, 2011. Second by Staloch. Staloch, Yes. Callahan, Yes. Motion carried.

Midcontinent/Dale Robbins

Motion by Staloch to adopt amended Midcontinent lease-new lease being a month to month lease instead of yearly with Midcontinent giving 90 day notice if they should have to discontinue service due to the flooding. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

Sheriff Contract

Motion by Callahan to renew sheriff contract for 2012. Second by Staloch. Staloch, Yes. Callahan, Yes. Motion carried.

FEMA/SHPO

Motion by Callahan to approve the Draft SHPO letter recommending the creation of a web site documenting the history of Minnewaukan and the flood fight. Also, to preserve the history of the cities older homes and structures that may be destroyed or relocated due to the flooding. Second by Staloch. Staloch, Yes. Callahan, Yes. Motion carried.

Rural Water

Motion by Staloch to proceed with NCRWC water supply project. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

Snow Removal Bids

Motion by Callahan to accept bid from Spirit Water Construction for snow removal for 2011-2012 for $60.00 an hour for the use of a skid steer, truck and man hours together. Second by Staloch. Staloch, Yes. Callahan, Yes. Motion carried.

Signature Cards

Motion by Staloch to remove McQuoid from signature card at bank and place Callahan on signature card. Second by Motis. Staloch, Yes. Callahan, Yes. Motion carried.

City Computer

Motion by Staloch to sell old city computer for 25.00. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

Harlow Elevator Lease

Motion by Staloch to amend Harlow Elevator lease to $1100.00/yr with the stipulation they mow the property. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

FSA Lease

Motion by Staloch to table this issue. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

ND Water Users Association

Motion by Staloch to pay dues to ND Water Users Association for 2012. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

Ordinances

Chapter 3

Motion by Staloch to adopt revisions to Chapter 3. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

3.0201 Any person, firm or corporation blowing leaves or grass clippings into the street will be fined not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00).

3.0210 Any person, firm or corporation who shovels or blows snow out into the street shall be fined not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00). Special consideration will be given to Main street where no boulevard exists.

Chapter 4

4.0505 Fireworks – Discharging of, Sale of, Penalty

The sale, use, firing, or discharging of any rocket, firecracker, torpedoes, roman candles, or of any such “Fourth of July” explosives whatsoever, or fireworks within the City limits is expressly prohibited at any time whatsoever, except as provided by in this chapter and state statute.

No person shall within the City of Minnewaukan set off, explode, or detonate any fireworks before July 1 or after July 5 in any year, except as provided in this chapter.

No person shall within the City of Minnewaukan set off, explode, or detonate any fireworks other than during the hours of 10:00 A.M. and 12:00 midnight during the dates listed herein.

Any person, firm, or corporation violating this ordinance shall be fined not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) per infraction.

Christmas Bonus

Motion by Staloch to give each of the 4 regular employees of the city $100.00 Christmas Bonus. Second by Callahan. Staloch, Yes. Callahan, Yes. Motion carried.

There being no further business the meeting adjourned at 7:16 pm. The next regular meeting will be held on January 10, 2012 at 4:30 in the City Library.
