The issue of this RFP does not imply that the Authority is bound to select an Applicant or to appoint the Selected Applicant, as the case may be, for the Consultancy and the Authority reserves the right to reject all or any of the Proposals without assigning any reasons whatsoever.

The Applicant shall bear all its costs associated with or relating to the preparation and submission of its Proposal including but not limited to preparation, copying, postage, delivery fees, expenses associated with any demonstrations or presentations which may be required by the Authority or any other costs incurred in connection with or relating to its Proposal. All such costs and expenses will remain with the Applicant and the Authority shall not be liable in any manner whatsoever for the same or for any other costs or other expenses incurred by an Applicant in preparation for submission of the Proposal, regardless of the conduct or outcome of the Selection Process.

Sub: Consultancy Services for providing Socio-Technical Facilitation to Government of India supported 23,431 housing beneficiaries for reconstruction of houses in 20 VDCs of Nuwakot District and 26,579 housing beneficiaries for reconstruction of houses in 27 VDCs of Gorkha District in Nepal

1.1  PROJECT BACKGROUND

1.1.1.  The earthquake of 25 April 2015 of 7.8-magnitude and subsequent aftershocks, including the one of 7.3 magnitude on 12 May 2015 in Nepal, killed nearly 9,000 people, injured more than 22,000 and destroyed more than 5,00,000 homes.

1.1.2.  During the International Conference on Nepal’s Reconstruction held on 25 June 2015 in Kathmandu, Government of India pledged US$ 1 billion (US$ 250 million in grant and US$ 750 million in concessional loan) for post-earthquake reconstruction in Nepal.

1.1.3.  A Memorandum of Understanding (MoU) on Utilization of the Grant Component of India’s Assistance Package for Post-Earthquake Reconstruction in Nepal signed on 20 February 2016, inter-alia, allocated US$ 100 million to support reconstruction of 50,000 private houses in Nepal. A Dollar Line of Credit Agreement of US$ 750 million for post-earthquake reconstruction was signed in September 2016.

1.1.4.  No funds provided by the GoI shall be used directly for tax payment. GoN shall exempt from import duties, value added tax, fees and any other taxes levied by the GoN, on all goods and services for the implementation of the project under this MoU. In the case of value added tax (VAT) GoN shall exempt if the materials are imported and shall refund if the materials and services are procured locally. However, in the case of Income tax the provision of Double Taxation Avoidance Agreement signed between the GoI and GoN will be applicable.

1.1.5.  In the Joint Statement issued during the visit of the Prime Minister of Nepal to India in September 2016, it was stated that Line of Credit could be used to meet the enhanced grant amount announced by the Government of Nepal for house owners. Government of Nepal increased the support given to each housing beneficiary for reconstruction of their houses from NR 200,000 to NR 300,000.

1.1.6.  The implementation of this Project will be based on Government of Nepal’s Owner-Driven Reconstruction Model. The Socio-Technical Facilitation Consultants (hereinafter referred to as “STFC”) selected through this RFP process, inter-alia, would provide technical guidance to the house owners for reconstruction of their houses with earthquake resilient features.

1.2  PROJECT LOCATION

1.2.1  Government of Nepal has allotted 50,010 housing beneficiaries to Government of India in 20VDCs in Nuwakot district [23,431 beneficiaries], namely, Bageswori, Balkumari, Barsunchet, Bidur Municipality, Bungtang, Charghare, Dangsing, Deurali, Gorsyang, Jiling, Kalyanpur, Kaule, Khadag Bhanjyang, Khanigaun, Kharanitar, Kimtang, Madanpur, Manakamana, Samari, and Sundaradevi and 27 VDCs in Gorkha district [26,579 beneficiaries] namely, Aanppipal, Bhumlichok, Chhoprak, Chyangli, Deurali, Dhunwakot, Finam, Gaikhur, Gankhu, Ghairung, Ghyachok, Gorkha Municipality, Gumda, Harmi, Kashigaun, Kharibot, Khoplang, Lapu, Makaising, Manakamana, Manbu, Mirkot, Nareshwor, Palungtar Municipality, Taklung, Tanglichok and Thalajung.

1.2.2  Location maps of the above mentioned VDCs in Nuwakot and Gorkha districts are at Annexure-1 of this RFP Document

1.3  TERMS OF REFERENCE

A brief description of the assignment and objectives & scope are given in Section-5 of this RFP.

1.4  INVITATION OF BIDS

1.4.1  The Embassy of India, Kathmandu, Ministry of External Affairs, Government of India (the “Authority” or “Client”) invites Proposals from shortlisted companies/organizations for appointing two STFCs for providing socio-technical facilitation for Government of India supported reconstruction of 50,010 houses in 47 VDCs in Nuwakot and Gorkha district of Nepal. The Project has been divided in 02 (two) Packages as under. Two STFCs shall be selected, one for each Package.

1.4.2  Selection of two STFCs shall be based on a Quality and Cost Based Selection (QCBS) system and as per the procedures described in this RFP document. Bidder shall be deemed to have understood and agreed that no explanation or justification for any aspect of the Selection Process will be given and that the Authority’s decisions are without any right of appeal whatsoever.

1.4.3  A Bidder may submit proposals for more than one package. However, the same Bidder will not be allowed to bid for a package with more than one team of Experts. For the sake of clarity, it is mentioned that one Bidder cannot submit two proposals/ bids for the same package. A Bidder (either as sole or as in JV/Association) shall be awarded only one package. Bidders are hereby invited to submit proposals in the manner as prescribed in the RFP. A Bidder may submit separate “Technical Proposals” for different packages. However, the package(s) for which a Bidder applies should be clearly mentioned. Financial proposal for each package is to be submitted separately. The most preferred bidder (H-1) for each package would be determined on the basis of Quality and Cost as mentioned in the RFP. Award of work to a Bidder either as sole or as in JV/Association shall be limited to one package only. In case, a Bidder turns out to be the most preferred bidder (H-1) in more than one package, the package which is to be awarded to this Bidder shall be determined on the basis of least cost to the Authority considering the financial quote of H-1 bidder and H-2 bidder limited to those packages, which shall be worked out as per the procedure given in the Data Sheet.

1.4.4  Bidders may acquire information fully about the assignment and the local conditions, before submitting the Proposal, by paying a visit to the Project site, sending written queries to the Authority, and attending the Pre-Proposal/Pre-bid Conference on the date and time specified in the Data Sheet in Section- 2.

1.4.5  The Bidder shall submit its Proposal in the form and manner specified in this RFP Document. The Technical proposal shall be submitted in the format given in Section-3 and the Financial Proposal shall be submitted in the format given in Section-4. Upon selection, the Consultant shall be required to enter into an agreement with the Authority in the form specified at Section-6.

1.4.6  The Bidders shall submit proposals either in sole capacity or in JV or in Association as shortlisted at EoI stage. The applicant will be the leader of consortium/ JV. Leader of the consortium/ JV should satisfy the pre-qualification criteria and confirm unconditional acceptance of full responsibility of executing the scope of work for this job. The confirmation should be submitted along with the RFP proposal. Any entity which has been barred or blacklisted by the Government of India or Nepal/UN or its implementing agencies and the bar remains in force as on the date of application, would not be eligible to submit the bid. It is not permissible to transfer this invitation to any other Consultant.

1.4.7  Financial Proposals will be opened only for the firms found to be eligible and scoring qualifying marks in accordance with Para 1.12, 1.13 & 1.14 hereof. The consultancy services will be awarded to the highest ranking Consultant on the basis of Quality and Cost.

1.4.8  Please note that (i) costs of preparing the proposal and of negotiating the contract, including visits to the Authority, etc., are not reimbursable as a direct cost of the assignment; and (ii) Authority is not bound to accept any of the proposals submitted and reserves the right to reject any or all proposals without assigning any reasons.

1.4.9  The proposals must be properly signed as detailed below:

  1. by the proprietor in case of a proprietary firm
  2. by the partner holding the Power of Attorney in case of a firm in partnership (A certified copy of the Power of Attorney on a stamp paper of INR 100 and duly notarized shall accompany the Proposal).
  3. by a duly authorized person holding the Power of Attorney in case of a Limited Company or a corporation (A certified copy of the Power of Attorney on a stamp paper of INR 100 and duly notarized shall accompany the proposal).
  4. by the authorized representative in case of Joint Venture.

1.4.10  In case a Joint Venture, the proposal shall be accompanied by a certified copy of legally binding Memorandum of Understanding (MOU) on a stamp paper of Rs.100, signed by all firms to the joint venture confirming the following therein:
