REPORT

Regarding results of the exaimination of public administration reform implementation in some provincial departments, state-owned companies

On from 07/6/2005 to 16/6/2005, the Provincial Public Administration Reform (PAR) Steering Committee, in combination with the Provincial Party Committee Office, the Propanda and Instruction Board of the Provincial Party Committee, the Legislation Board of the Provinical People's Council, the Provincial People's Committee Office, the Provincial Department of Justice, the Provincial Inspectorate, examined the Provincial Department of Planning and Investment, the Provincial Department of Health Care, the Provincial Department of Roads and Transportation, the Provincial Department of Justice, the Provincial Industrial Zone Management Board, the Provincial Water Supply and Clearance Company. The purpose of the examination was to evaluate the implementation of the Resolution 14/NQ-TU dated 14/10/2004 by the Provincial Party Committee on direction of PAR implementation from now on till 2010; the Action Programme No 1320/CV-UB dated 03/12/2004 by the Provincial People's Committee and the implementation of administrative procedure reform through implementation of the OSS mechanism in different agencies during the past time in order to draw up experiences in what have been done and what have not and recommend solutions of reducing and then eliminating troubles caused for people, organizations when they come and submit their requests to be handled to state agencies to the Provincial People's Committee.

1- Real situation of implementation of the Resolution No 14 by the Provincial Party Committee and the Action Programme No 1320 by the Provincial People's Committee

The Resolution No 14 by the Provincial Party Committee and the Action Programme No 1320 by the Provincial People's Committee have been implemented for nearly 6 months, however, through the examination conducted , it is seen that none of the examined agencies have deeply and comprehensively implemented these legal documents towards all the target groups regulated by these legal documents. The activity that most of agencies have done is the dissemination of these legal documents in meetings of their Party Committees or Party Cells. None of them have made a plan for PAR implementation according to the assignments mentioned in Part IV of the Action Plan of the Provincial People's Committee. Except for the Provincial Department of Justice, which has made a draft plan but this draft plan is very general, does not identify concrete time duration and content of each activity, the rest examined agencies said to the Examination Group that they have been implementing these legal documents but finally could not show a written reports or documents for illustration. Even, the leaders of some agencies mistook PAR areas with each other in their speeches because they did not understand the PAR terms used in these documents.

In general, it can be seen through the findings of the examination that the implementation of the Resolution No 14 by the Provincial Party Committee and the Action Programme No 1320 by the Provincial People's Committee in the examined agencies does not meet the requirements as directed by the Provincial Party Committee and by the Provincial People's Committee. In the comming time, the Standing Board of the Provincial PAR Steering Committee will, in combination with the said-above agencies, examine the remaining agencies in order to clearly understand the real situation of implementation of these two legal documents and timely define solutions.

2- Reforming administrative procedures through implementation of the OSS mechanism

Most of the examined agencies have strictly implemented their proposals, which are already approved by the Provincial People's Committee. Out of these agencies, the Provincial Department of Justice has always tried to improve the dossier - handling process and to shorten the processing time in service of people and organizations, for example: time of granting of nationality certificate has been reduced from 30 to 15 days; time of parent, children adoption registration from 45 to 30 days; time of registration of marriage to a foreigner from 30 to 20 days; time of notarization of a contract, a real assets transaction, a transaction with a foreigner from 30 to 3 days depending on the complicatedness of the case.

The leaders of these agencies have paid much attention to select public officials who have good professional understanding, good working style and good communication to work in the OSS. As a result of this, troubles that people, organizations meet when coming to state agencies to have their requests handled have been reduced a lot.

Most of these agencies locate their OSS in a convinient, airy, clean place; post administrative procedures in a public, clear, easily read, easily seen way in a place with waiting chairs and tables and drinking water, arrange and fill in books in a scientific, full and easily accessible way; strictly implement fee, charge colelction, result returning in accordance with the regulation issued by the competent authority level.

The OSS mechanism has been implemented for a short time and is still a new mission. However, with the great effort taken by these agencies to overcome the difficulties of physical materials, personnel, the OSS mechanism implementation has been gradually gone in order, gained initial results such as reducing a lot of mistakes, troubles, delays raising during handling of requests of people, organizations, receiving welcome, support from the public opinions.

The Provincial Industrial Zone Management Board has processed 24 dossiers of investors on schedule after nearly 6 months of OSS mechanis implementation; the Provincial Department of Health 193 dossiers, many of which were very complicated, after 3 months; the Provincial Department of Roads and Transportation 127 dossiers of overloaded transportation certificates, 2,019 of motor driving certificates, 28,747 of motorbike driving certificates after 6 months; the Provincial Department of Justice 3,732 dossiers of civil status registration, 166,411 of notarization after nearly one year; the Provincial Department of Planning and Investment 1,124 dossiers of different kinds, many of which were complicated, after more than one year; the Provincial Water Supply and Clearance Company 1,416 dossiers of new water clock installation, 1,292 of water clock replacement, movement, amendment, 446 of water pipe replacement, movement after nearly one year. However, the Provincial Water Supply and Clearance Company does not fully and strictly observe to the provisions of the Decision on approval of OSS mechanism implementation proposal of the Provincial People's Committee regarding publicization of administrative procedures, dossier processing time, fees, charges; dossier receiving and result returning; name card wearing and as a result, troubles, confusion for people, organizations still remain .

3- Requests of examined agencies

+ The Provincial Department of Justice:

- It is requested that the Provincial Party Committee, the Provincial People's Committee consider and allocate budget for the Department to build a new office because its current office is too small.

- It is requested that the Provincial People's Committee allow the No 1 Notarization Office to implement the self-financing mechanism.

+ The Provincial Department of Health Care:

- It is requested that the level of budget allocated according to the blockgrant mechanism is increased from 23 to 30 million VND per person per one year with the aim to encourage competent people to come and work for the Department

- It is requested that the Department is provided with one more post in its allocated staffing size so that it can recruit a person to work in its OSS.

4- Recommendations of the Examination Delegation:

- It is recommended that the Provincial Party Committee direct its units to coordinate with concerned agencies to examine the remaining provincial departments, agencies and the district agencies.

- It is recommended that the Provincial People's Committee direct the Branches of Roads and Transportation, Construction, Agriculture and Rural Development, Post and the district-level People's Committees to develop a regulation on responsibility coordination in development of rural and urban roads with the aim to reduce wastfulness in investment and troubles for people.

- It is recommended that the Provincial People's Committee direct the Branches of Planning and Investment, Construction, Natural Resources and Environment, Science and Technology, Public Security (the Fire Prevention and Fight Bureau), Industrial Zone Management Board to develop a regulation on responsibility coordination in promptly processing administrative procedures according to the regulation by the competent authority level with the aim to facilitate investors coming to the province

- It is recommended that the examined agencies that receive comments from the examination delegation as mentioned in this report solve their shortcomings according to the provisions on OSS mechanism implementation as soon as possible
