Dear Mr Dunham:

This is to inform you that the Board of Appeals has voted to act on your application for an administrative appeal at its meeting on December 28, 2009, and made the following findings and conclusions:

Findings of Fact

1. The owner of the property is: Peter D. Dunham

2. The property is located at 241 Twombley Rd, Sanford, ME 04073

It is in the Residential Development Zone and is identified as Assessor’s Map R11, Lot 77.

3. The applicant is Peter Dunham of 241 Twombley Road , Sanford, ME 04073.

4. The applicant proposes to allow the garage to include the kitchen and its use for family members only.

5. A “Notice of Violation” was sent to the applicant and owner of the property following an inspection by

the Codes Enforcement Officer on October 19, 2009.

6. A Public Hearing was held on: December 28, 2009

7. The relevant sections of the ordinance: Section 280-73 of the Town Code.

8. Other relevant facts are: As listed in the letter dated November 24, 2009 and submitted to the applicant

from the Chief Codes Enforcement Officer.

Conclusion: The evidence does not establish an error in any order, requirement, decision, or determination

of the Code Enforcement Officer because the dwelling does not follow Town Code as per Section 280-73. The original application was an approval of a room and not an apartment unit as outlined in the CEO’s letter dated November 24, 2009.

Decision: Based on the findings of fact and conclusions stated by the Board above, the Board Denies the

appeal.

Appeals: If you are unhappy with this decision, you may request a reconsideration by the Board within 30 days of the date of this decision. You may file an appeal in the Superior Court within 45 days of the date of this decision.
