BUTTERFINGER Employee Virtual Bake Off Contest Rules
SWEEPSTAKES IS OPEN TO ELIGIBLE FULL-TIME AND PART-TIME EMPLOYEES OF NESTLE USA CORPORTE OFFICES LOCATED IN SOLON, GLENDALE AND OAKLAND, and NESTLÉ PROFESSIONAL, LOCATED IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE 18 YEARS OF AGE OR OLDER AND HAVE ACCESS TO THE NESTLÉ CHATTER TOOL (collectively “ELIGIBLE EMPLOYEES”). PROMOTION SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER IF YOU ARE NOT A FULL-TIME OR PART-TIME AN ELIGIBLE EMPLOYEE. PROMOTION IS NOT OPEN TO CONTRACTORS OR THE GENERAL PUBLIC.

Promotion Period and Details: The promotion consists of a contest (“Contest”) that will run between 8:00 AM Eastern Time (“ET”) on 10/26/15 and 9:00 PM ET on 10/30/15 (“Contest Period”), and a Voting Sweepstakes that will run between 8:00 AM Eastern Time (“ET”) on 0/10/2600/15 and 9:00 PM ET on 100/300/15 (“Sweepstakes Period”), together the Promotion Period.
To Enter/Participate:
Contest Period. Eligible Employees can access Chatter via the Chatter website (“Site”) located at: https://thenest.my.salesforce.com/_ui/core/chatter/groups/GroupProfilePage?g=0F9D0000000UiLs and follow the instructions to join the One Nestlé U.S. Chatter Group. Post a photo of your recipe using BUTTERFINGER® candy with the hashtag #BFBakeOff during the Contest Period (“Entry”). All terms and conditions of the Chatter Site apply..
You may submit as many Entries as you wish, however each Entry must meet the requirements below and be different. Participation in the Chatter promotion is completely voluntary and no one is required to participate. Any time spent participating in the promotion will not be considered compensable work time and therefore should be done on an individual’s personal time if they choose to submit an entry.
Sweepstakes Period: Eligible Employees who vote for their favorite recipe on Chatter by posting a comment with the hashtag #BFBakeOff to the original recipe post during the Sweepstakes Period, will receive one entry into the sweepstakes. Limit one entry per Eligible Employee.
Contest Entry must meet all of the following requirements or it will be disqualified:
· Photo submitted via chatter must be in standard photo format (jpeg, gif, tif, etc.)
· Entry must be original, unpublished, the sole property of submitter and not previously submitted in any other contest.
· Entry must not incorporate/display any third-party brands or trademarks other then required and stated in these official rules.
· Entry must not violate any third-party rights, including copyright and right of publicity.
· At the judges' discretion, entries including unsuitable content or that are in violation of third-party rights (including, but not limited to, copyrights) will be immediately disqualified.
· All entries must be submitted in English.
· By submitting an Entry you agree Nestlé has the unrestricted right to use your Entry, commercially or non-commercially, including the right to publish and display the photo/story for advertising and publicity, all without additional review or compensation.
· All Entries become the property of Sponsor, and may be used without compensation.
· You must have written permission from any identifiable person who appears in your photo to use his/her likeness in the photo submission. If such person(s) is younger than 18, you must have written permission from minor's parent or legal guardian or, if you are the parent or legal guardian, you must consent to his/her appearance in the photo entry. Proof of written permission must be made to Nestlé immediately upon request.
Contest Period Judging: One winner will be selected from all eliegible entries received via chatter and email by Nestlé Chef Christine Garboski, who will be judging all eligible entries based on originality, creative use of BUTTERFINGER, and visual appeal. Potential winner will be asked to submit the actual recipe including measurements and ingredients.
The second winner will be selected by employees who will vote for their favorite Entry on the ALL NUSA chatter page using the #BFBakeOff hashtag in the comment on the original post. The Entry that receives the most votes posted to their entry will be the winner. In the event of a tie, Christine Garboski will select the winner.
Winner selection/notification:
Contest: Potential winner will be notified via their work email or phone on or about 11/05/15 Potential winner will be asked to submit the actual recipe including measurements and ingredients.
Sweepstakes: Potential Winner will be selected in a random drawing from all eligible entries received on or about 11/05/2015. Odds of winning depend upon the number of eligible entries received. Potential Winner will be notified via their work email or phone on or about 11/05/2015
If winner is unreachable or does not make direct contact with Sponsor by date specified in notification, prize will be forfeited in its entirety and another winner may be chosen. Limit one prize per person or address.
Prizes:
CONTEST: Two (2) Prizes; each winner will receive 100 Real Recognition Points (ARV approximately $285___).
SWEEPSTAKES: _Three __ (_3_) Prizes: each winner will receive 50 Real Recognition Points (ARV approximately $143___). Expenses not specifically stated herein are the sole responsibility of the Winner. No cash substitutions for prizes will be permitted and prizes are nonrefundable and nontransferable, except at sole discretion of Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. Federal, state and local taxes are the sole responsibility of the winner.
Eligibility: Open to full and part time employees of Nestle USA Corporate offices located in Glendale, Solon and Oakland, and NESTLÉ PROFESSIONAL, (“ELIGIBLE OPCO’S”), located in the 50 U.S. and D.C., 18 or older who have access to the Nestlé Chatter tool. Contest not open to contractors or the general public. Nestlé USA, Inc. and its affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession or loss of the prize. Void where prohibited or restricted by law. Subject to all federal state and local laws.
General: By entering the Sweepstakes, entrants accept and agree to these rules and the decision of the judges, which shall be final. By submitting an entry, entrants agree to allow use of their name, entry and/or photograph for advertising this or similar promotions (including Internet posting) without compensation unless prohibited.
Other Conditions: Employee acknowledges and agrees participation in the Sweepstakes is voluntary and shall not be deemed a part of employee’s work requirements. Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Promotion, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures or other causes beyond Sponsor’s control, corrupt the administration, security, fairness, integrity or proper play of the Promotion. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or used in the Promotion by technical or human errors, which may occur in the processing of the entries in the Promotion. Sponsor reserves the right to withdraw the transmission of this Promotion at any time and award the prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or Web site or to be acting in violation of the rules.
