The meeting was held at 1114 S. DuPont Hwy. Dover, DE. A quorum of the Board was present for the meeting. Present: Elmer L. Newlin, Chairman of the Board, Vance G. Daniels, Sr., D. Dryden, and A. Wayne Meluney, Board Members. Mary Page Bailey, Deputy Attorney General, attorney for the Board, and Helen McClure, Appeal Board Secretary.

THE FOLLOWING CASES WERE HEARD BY THE BOARD:

Jack Lassiter v Randy C. Mitchell Painting - AD # 735660

A request for postponement was made by the employer. Elmer L. Newlin, Chairman of the Board, granted the request.

Diane K. Parsons v Atlantis Industries, Inc. - AD # 735736

A request for postponement was made by the employer. Elmer L. Newlin, Chairman of the Board, granted the request.

David C. Wingate v Apple American Group, LLC - EMP - AD # 437851

Present: David C. Wingate, claimant; Tim Fleming and Reed Walters, employer representatives. A motion was made by Mr. Dryden and seconded by Mr. Meluney. The Board moved affirm the Referee and award benefits. Mr. Newlin, Mr. Daniels, Mr. Dryden, and Mr. Meluney agreed to the motion.

Tavia Mullen v None Involved – AD # 437731

Present: Tavia Muller, claimant; Anja Deputy, Department of Labor representative. A motion was made by Mr. Meluney and seconded by Mr. Dryden. The Board moved to affirm the Referee and deny benefits. Mr. Newlin, Mr. Daniels, Mr. Dryden, and Mr. Meluney agreed to the motion.

Drew Wilson, claimant, although duly notified, failed to appear. Present: Charles Shiery, employer representative, Jeffrey Shiery and Angelo Triglia, employer witnesses. A motion was made by Mr. Newlin and seconded by Mr. Meluney. The Board moved to reverse the Referee and deny benefits. Mr. Newlin, Mr. Daniels, Mr. Dryden, and Mr. Meluney all agreed to the motion.
