AMENDMENT

ThismattercomingonforhearingbeforetheCommissionatBrisbaneon20December2005thisCommissionordersthatthesaidAwardbeamendedasfollowsasfrom20December2005:

1.Byinsertinganewclause7.1.7asfollows:

"7.1.7Whereanemployerclosesdowntheirplantorasectionorsectionsthereofforthepurposeofallowingannualleavetoallorthebulkoftheemployeesintheplantorthesectionorsectionsconcernedandthereareanyemployeeswhohavenotqualifiedforthefullperiodof5weeks' or4weeks' annualleaveasthecasemaybe,theemployermay,inrespectofsuchemployee:

(a)paytothoseemployeeswhowouldqualifyforthefiveweeksannualleave,anamountequivalentto1/9thofoneweek'swagesforeachweekofserviceandtothoseemployeeswhowouldqualifyforthe4weeks' annualholiday,anamountequivalentto1/12thofoneweek'swagesforeachweekofservice,andstandthemoffduringthebalanceoftheclosingdownwithoutpay;or

(b)allowsuchemployeestotakefull5weeks' or4weeks' annualleave,asthecasemaybe,inwhichcasenofurtherannualleaveshallcommencetoaccrueuntilaftertheexpirationofthefullperiodwhichwouldhavequalifiedtheemployeesforsuch5or4week'sleave;

(c)alltimeduringwhichanemployeeisstoodoffwithoutpayforthepurposeofclause7.1.7shallbedeemedtobetimeofserviceinthenext12monthlyqualifyingperiod,providedthatthisshallnotapplywheretheperiodofemploymentincludingtheperiodstooddowndoesnotexceed5weeks:

Providedthattheforegoingconditionsshallalsoapplyintheeventofannualleavebeingstaggeredsothatemployeesentitledtoannualleavemaybebrokeninto2groupswhichoverlapintoaclosedowninaccordancewiththefirstparagraph,ofnotmorethan2workingweeks(pluspublicholidaysoccurringtherein)andemployeeswithalesserperiodofservicemaybestooddownasinclause7.1.7(a).".

2.Byinsertinganewclause7.7.7asfollows:

"7.7.7Absencesbeforeorafterpublicholidays

Whenemployees,paidonaweeklyrate,absentthemselveswithoutpermission,ontheworkingdayprecedingortheworkingdayfollowingapublicholiday,exceptLabourDay,theyshallnotbepaideitherfortheholidayorforthedayonwhichtheyabsentthemselves.".
