INDEMNIFICATION:LesseeagreestoindemnifyandholdharmlessLessorandLessor’ssuccessor’s,assigns,agents,ownersandrelatedpersonsorentitiesfromanyandallclaims,demandsandlawsuits(includingattorneyfeesandalllegalandcourtcosts)thatarebroughtbyothersarisingoutofLessee’suseofLessor’sstoragefacility.

VEHICLES:Allvehicles,boats,RV’s,snowmobiles,fourwheelers,PWC’s,trailersandanyotherfuelcontainingitem placedinstorageshallhaveafulltankofgasoline,dieselorotherfueltoreducethedangeroffumes.

FULLSERVICESTORAGE,LLCisnotinthewarehousebusiness,norinthebusinessofstoringgoodsforhire.UndernocircumstanceshallFULLSERVICESTORAGE,LLCbedeemedtobeabailee,othertypeofcustodian,orawarehousemanasusedinSubsection70A-7-102(1)(h)oftheUtahCode.FULLSERVICESTORAGE,LLC’semployeesareforbiddenfromprovidingservicestoLesseeonbehalfofFULLSERVICESTORAGE,LLCexceptthose specificallyauthorized in the FULL SERVICE STORAGE,LLC pricelist orthose servicesauthorized by amanager of FULLSERVICESTORAGE,LLC.ShouldemployeesofFULLSERVICESTORAGE,LLCprovideservicesatLessee’srequest,theyshallbedeemedtobeagentsofLessee.

RENT:LesseeshallpaytoFULLSERVICESTORAGE,LLCinadvance,oronthefirstdayofeachmonthbyautomaticcreditcardpaymentorothermethod, therentforthatmonth.Lesseeagreestopaythelatechargefor rentreceivedatthesiteafter5:00p.m.onthe10thday ofthemonthfor whichitisdue.FULLSERVICESTORAGE,LLCmayacceptchecksforpaymentofrent.Ifacheckisreturneduncollected,paymentsrepresentedbyitshallbeconsidereddelinquenton thedateoriginallydue.FULLSERVICESTORAGE,LLC mayincreasetherentbynotifyingLESSEEinwritingatleast30dayspriortothefirstdayofthemonthfor whichtheincreasedrentisdue.LESSEEshallpaytheincreasedrentfor thedateitbecomeseffective.IfLESSEEisunwillingtopaytheincreasedrent,LESSEEmayterminatethisRentalAgreementasprovidedintheparagraph“PeriodofOccupancy”. Lessormayterminatethisagreementupon30daysnoticeforanyreasonincluding,butnotlimitedto,sale,fire,partialorcompletedestructionofLessor’sstoragefacilityorotherdispositionoftheproperty.AllarticlesstoredunderthetermsofthisRentalAgreementwillbesoldorotherwisedisposedofiffullpaymenthasnotbeenreceivedmorethanthirty(30)daysafterpaymentisdue.FULLSERVICESTORAGE,LLCwillactingoodfaithinanysuchsaleorotherdispositionandshallnotbeliableforanyclaimsonaccountofthepropertysold,pursuanttoUtahCodeAnnotated38-8-1et.seq.

PERIODOFOCCUPANCY:TheperiodofoccupancycreatedbythisRentalAgreementshallbeginasofthedateofthisRentalAgreementandshallcontinuefrommonthtomonth,unlessotherwiseagreedinwriting,exceptforapossiblepartialfirstcalendarmonthtothelastdayofthatcalendarmonth.LESSEEorFULLSERVICESTORAGE,LLCmayterminatetheoccupancycreatedbythisRentalAgreementbydeliveringwrittennoticetotheotherpartyofits intentionto dosoatleast15 days priorto thefirstdayof thecalendar monthin whichoccupancywillterminate.Anyproperty leftin thestoragespaceafterthedateforwhichLESSEEhasgivennoticetoterminatewillbedeemedabandonedbytheLESSEE.Aftersaiddate,FULLSERVICESTORAGE,LLCmayremoveanylockfromthestoragespaceanddisposeofthecontentsthereofwithoutnoticeorliabilitytotheLESSEE.FULLSERVICESTORAGE,LLCshallgivenoticetoanylienholderwithaninterestinthepropertytobedisposedof,ofwhomFULLSERVICESTORAGE,LLChasknowledgeeitherthroughthedisclosureprovisiononthisRentalAgreementorthroughfindingavalidlyfiledfinancialstatement,asprovidedbylaw.FULLSERVICESTORAGE,LLCmayalsoterminatethisRentalAgreementbyanymeansprovidedbylaw.

RESPONSIBILITYFORLESSEE’SPROPERTY:FULLSERVICESTORAGE,LLC(Lessor)shallhavenoliabilityfordamageorlosscausedbyearthquake,flood,heat,cold,theft,vandalism,fire,water,winds,dust,rain,explosion,rodents,insectsoranyothercausewhatsoever.FULLSERVICESTORAGE,LLCcarriesnoinsurancecoveringalossofortoLESSEE’sproperty.LESSEEshallmaintainaliabilitypolicyandapropertypolicyforfireandextendedcoverageinsuring,amongotherthings,fortheft,vandalism,andmaliciousmischieftotheextentof100%ofthereplacementvalueofthepropertyinthestoragespace.TotheextentLESSEEdoesnotmaintainsuchinsurance,LESSEEherebyagreestoself-insurethepropertytothesameextentassuchapolicywouldhaveprovided.FULLSERVICESTORAGE,LLCshallnotbeliabletoLESSEEortoLESSEE’sinviteesorothersforpersonalinjuriesordamagetopersonalpropertycausedbyanactornegligenceofanypersononsaidpremises.LESSEEherebyagreestoindemnifyandholdharmlessFULLSERVICESTORAGE,LLCfromanyandallclaimsfordamagestopropertyorpersonalinjuryandcostsincludingattorneys’feesarisingfromLESSEE’suseofthepremisesorarisingfromanyandallitemsofLessee’sinstorageatLessor’sproperty.LessorshallnotbedeemedtoeitherexpresslyorimpliedlyprovideanysecurityprotectiontoLESSEE’spropertymaintainedatthesite.AnysecuritydeviceswhichFULLSERVICESTORAGE,LLCmaymaintainatthesiteareforFULLSERVICESTORAGE,LLC’sconvenienceonly,andFULLSERVICE STORAGE,LLCmay discontinue theiruse in whole or in part atany timewithoutnotice to LESSEE.Lessee (You) agreeson behalf of LesseeandLessee’sinsurers,successorsandassignstowaiveallsubrogationrightsagainstLessororitsinsurers,successors,agents,assigns,ownersorrelatedpersonsorentitiesforanyandalldamageorinjuryresultingfromuseoractivityatLessor’slocationincluding,butnotlimitedto,claimsforuninsured,underinsuredorself-insuredamountsordeductibles.

LESSEEshallcomplywithallgovernmentallaws,rulesandregulationsregardingthestoragespace.LESSEEshallnotusesuchspacetostoreanydangerousorillegalitemsorsubstancesincluding,butnotlimitedto,liveanimalsororganisms,deadanimals,gasoline,diesel,fuelofanysort,fireworks,ammunition,firearms,toxic substances,oxygen tanks,asbestosor asbestoscontainingmaterials,stolen property,illegal items orinflammable, combustible,explosive,corrosive,perishable,noxiousordangerousmaterials.LESSEEshallnotplaceanysignsonoraboutthespace.LESSEEshallnotusethestoragespaceforresidentialpurposes.LESSEEshallnotusethestoragespaceforactivestorage,i.e.,manufacture,fabricationor maintenance.LESSEEWARRANTSTHATALLITEMSPLACEDBYLESSEEINTHESTORAGESPACESHALLBELESSEE’SOWNPROPERTY,FREEOFALLINTERESTSORLIENSORANYLIENHOLDERSEXCEPTTHOSEWHICHASREQUIREDBYLAW,LESSEEHASDISCLOSEDINTHIS

RENTALAGREEMENTORINSUBSEQUENTWRITTEN NOTICETOFULLSERVICESTORAGE,LLC.AllpersonalpropertylocatedinthestoragespaceshallbesubjecttoenforcementofFULLSERVICESTORAGE,LLC’sliensforrent,labororotherchargesinrelationtothepersonalpropertyandforexpensesnecessaryforitspreservationorreasonablyincurredinthesaleorotherdisposition,asprovidedbylaw.LESSEEshallnotplaceanymaterialorpersonalpropertyoutsidethestoragespace.Anypersonalpropertyormaterialfoundoutsidethestoragespaceshallconclusivelybepresumedtobeabandonedand maybedisposedofbyFULLSERVICESTORAGE,LLCwithoutanyliabilityofFULLSERVICESTORAGE,LLC toLESSEE.LESSEEauthorizesFULLSERVICESTORAGE,LLCtoremoveanylocksasmayberequiredbyLessor.

DELIVERYOFNOTICE:LESSEE’saddressshallbeconclusivelypresumedtobetheaddressprovidedbyLESSEEinthisRentalAgreementunlessLESSEEprovidesFULLSERVICESTORAGE,LLC withsubsequentwrittennoticeofachangeofaddress.AllnoticerequiredorpermittedbythisRentalAgreementshallbepresumeddeliveredwheneitherdeliveredinpersonordepositedintheUntiedStatesPostalServiceMailproperlyaddressedwithpostageprepaid,exceptasotherwiseprovidedbylaw.

DEFAULTBYLESSEE:TimeisoftheessenceinperformanceofobligationscreatedbythisRentalAgreement.FailureoftheLESSEEtoperforminatimelymanneranyobligationordutysetforthinthisRentalAgreementshallconstitutedefaultandFULLSERVICESTORAGE,LLCmayproceedtodoanyorall of thefollowing: (a) Provide written noticeof thedefaultand FULLSERVICESTORAGE,LLC’s claimto the LESSEE,to anylien holder withaninterestin the property, of whomFULLSERVICESTORAGE, LLChas knowledgeeitherthrough thedisclosureprovisionsofthis Rental Agreement orthroughfindingavalidlyfiledfinancingstatement,ANDTOTHESHERIFFOFTHECOURTINWHICHTHESITEISLOCATED.SuchnoticeshallincludeanitemizedstatementofFULLSERVICESTORAGE,LLC’sclaim,abriefandgeneraldescriptionofthepersonalpropertysubjecttoFULLSERVICESTORAGE,LLC’slien,notificationofdenialofaccesstothepersonalproperty,ademandforpayment,andastatementthat,unlessthe claimispaidwithinthetimestated,thepersonalpropertywillbesoldorotherwisedisposedof,asprovidedbylaw;(b)DenyLESSEEaccesstothepersonalproperty;(c)TerminateLESSEE’srightofpossessionofthestoragespacebylawfulmeans.InadditiontotheamountofFULLSERVICESTORAGE,LLC’slien,LESSEEshallbeobligatedtoFULLSERVICESTORAGE,LLCforallcosts,interestof21%,attorneysfees,costs,andexpensesassociatedwith enforcement byFULLSERVICESTORAGE,LLCofitsrights,including without limitation,reasonableattorneys’fees, courtcosts,serviceofprocessfees,appraisalfeesandanyandallothercosts,asallowedbylaw.

MISCELLANEOUS:(a)IfanyportionofthisRentalAgreementforanyreasonisdeclaredinvalid,suchdecisionshallnotaffectthevalidityofanyremainingportionoftheRentalAgreement.(b)Alltheprovisionshereofshallapplyto,bindandobligatetheheirs,personalrepresentatives,successors,assigns,agentsandrepresentativesofthepartieshereto.(c)TheprovisionsofthisagreementandtherightsofthepartiesheretoshallbeconstruedinaccordancewithapplicablelawoftheStateofUtah,includingbutnotlimitedtotheprovisionsrelatingtoself-storage,RegulationU.C.A.38-8-1,et.seq.

(d)NowaiverbyFULLSERVICESTORAGE,LLCitsagentsorrepresentativeofanybreachordefaultintheperformanceofanycovenant,condition,ortermcontained herein shall constituteawaiverof anysubsequentbreach ordefault in the performance ofthe same or anyother covenant, condition or termhereof.(e)NosublettingoftheLESSEE’sstoragespaceoranyportionthereoforassignmentofthisRentalAgreementbyLESSEEispermitted.(f)ThisRentalAgreementistheonlyagreementofthepartiesandsupersedesanypriorwrittenororalagreement.NoamendmentoralterationofthisRentalAgreementshallbebindingunlessmadeinwritingsignedbybothparties.
