Notes: / Per Lew Conley 6/19/15 - I don’t have any problem with the changes. I still feel that the Tidelands issue will require a constitutional amendment, but that is for the attorneys to worry about, not us. At our meeting Tuesday, our position was to Support these bills. My recommendation is still to Support.
Per Pete Burgess - 3/26/13 - Am I reading this correctly? Property owners could now adverse possess against the state. Didn't the tidelands issue cause all sorts of problems some 30 years ago? And didn't the tidelands and formerly or once flowed lands have to be purchased again from the state. didn't this go to the state supreme court? That said I think if all parties concerned in any specific property's transaction acted properly thru its history I don't think the land owner should pay twice. But allowing an opportunity for adverse possession against the state is a bad idea. I also believe that if allowed here the concept will be expanded to other situations.
Per Lewis Conley - 3/26/13 - That is my understanding also. The constitutional amendment was circa 1988, a portion of which is contained on all of the States Tidelands Claims maps and reads as follows: "Article VIII, Section 5, Paragraph 1 of the New Jersey Constitution requires the State to assert its riparian claim to land which has not been flowed by the tide since November 3, 1941, by November 9, 1982, or forfeit its claim. Similarly, as to land which acquires the status of property not tidally flowed for 40 consecutive years after November 3, 1981, the State must assert its riparian claim before the conclusion of the 40 year periodor lose it. These maps are adopted to avoid these forfeitures and constitute the State's claims to riparian lands. The claims lines do not reflect the changes constantly occurring from the movement of land and water at the ocean's shore and elsewhere, or the impact of additional data which may become available or usable after the maps were drawn. Also, the claims lines do not show valid grants made by the State and, therefore, also do not reflect grant overlaps, ungranted riparian land inshore or adjacent to grants, or the legal effects of failed grants. Nor do the lines drawn reflect or impact on claims made in particular litigation, or reflect filing under the Wharf Act

Notes: / Per Barry Gleissner - 2/24/14 - We are in support of this Bill and we would ask that Assemblymen Deignan be approached and ask to remove the portion pertaining to having the landowner sign a waiver to have the outbound corners set when preparing a subdivision. It is our opinion that when a newly created lot has been granted, property corners should be set so that the new owner is aware of their property extents. In the long run, this will allow the home owner to save time and money when a surveyor comes to the site to perform his work for stakeout of buildings, fences, etc. This will put everyone on notice as to where the new lines are located.
One other little thing in the Bill found on page 23, line 32: monuments set for a subdivision will have to contain the name of the surveyor and the name of the firm. Currently it is either one. If we could get this change made also, it would prove to be beneficial.
