In consideration of participating in the sport of gymnastics, acrobatics, cheerleading and/or any other activity at Tooele Gymnastics Academy (hereinafter TGA), I represent that I am in good health and in proper physical condition to participate in such activities. I fully understand that these activities are vigorous sporting activities involving height and rotation which involve the risk of serious bodily injury, including but not limited to permanent disability, paralysis, or even death and that the risk of harm may be caused by myself or others; and I fully accept such risks and all responsibilities for losses, cost and damages incurred as a result of the participation in said activities. I hereby release, discharge, and covenant not to sue TGA, and/or the Ninigret Depot, it’s respective administrators, directors, agents, officers, volunteers, employees, other participants, sponsors, advertisers, and if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages, caused or alleged to be caused in whole or in part by the negligence of the “Releasees” or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability and assumption of risk makes claims against any of the “Releasees”, I will indemnify, save and hold harmless each of the “Releasees” from litigation expenses, attorney’s fees, loss, liability, damage or cost which may occur as a result of such claim.

I have read the Waiver and Release of Liability in full and understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by the law and agree that if any of this agreement is held to be invalid, the balance, not withstanding, shall continue in full force and effect.

DISCLAIMER – TOOELE GYMNASTICS ACADEMY IS NOT RESPONSIBLE FOR ANY INJURY (OR LOSS OF PROPERTY) TO ANY PERSON WHILE PRACTICING, TRAINING, TAKING A CLASS, COMPETING, PARTICIPATING IN OPEN GYM, SPECIAL EVENTS, DEMONSTRATIONS OR SHOWS, OR IN ANY OTHER WAY INVOLVED IN GYMNASTICS, ACROBATICS, CHEERLEADING, PRE-SCHOOL OR TEAMS AT TOOELE GYMNASTICS ACADEMY FOR ANY REASON WHATSOEVER.
