7. Quantity Discounts: 1.98% - 50.34%. Volume discounts are offered on all listed Certol products as follows: If the government purchases over $1,500 dollars in value of any one of these products per order their price is reflected on the Commitment over $1,500 dollars. If the government purchases over $5,000 dollars in value of any one of these products per order their product price is reflected on the Commitment over $5,000 dollars. Single orders $1,200.00 - $4,999.00 1.4% - 8.5% additional discount; $5,000+: 3.8% - 22.6% on Certol products. See Attachment D

Please contact Medsav Solutions for additional discounts that may be offered on a per order basis. Discounts are based on either total product volume and/or total value in dollars for large purchases.

15. Warranty provision:

Government Warranty

SJ Medsav Solutions LLC (herein after referred to as “Contractor”) warrants that its products at the time of shipment by Contractor to the U.S. Department of Veterans Affairs and each authorized Federal Supply Schedule user (collectively “Government”) by Contractor or any affiliated or subsidiary thereof:

(a)  Will in all material respects have been manufactured in conformance with current good manufacturing practices as set for in Title 21 of the Codes of Federal Regulations at the time of manufacture; and

(b)  Will not be: (i) adulterated or misbranded by Contractor within the meaning of the Food, Drug, and Cosmetic Act, as amended (the “FD&C Act”) and (ii) an article that may not be introduced into interstate commerce under the provisions of Sections 404 or 405 of the FD&C Act; and

(c)  Will in all material respects, at the time of shipment, meet the technical specifications stated in the FDA-approved package insert.

Except as expressly provided herein, Contractor does not make any warranties of any kind, express, statutory, or implied. No oral or written information or advice given by an employee or representative of Contractor shall create a warranty for any products. Furthermore, the Contractor will not be liable to the Government in a breach of warranty action for consequential damages resulting from any defect or deficiencies in accepted items. The Government remedy in a breach of warranty action shall be refund of the product purchase price and/or replacement of product.

All products carried and sold by SJ Medsav Solutions LLC have a manufacturer warranty. Each manufacturer warranty’s information can be found below outlining exactly the warranties of each manufacturer NDC Pro Advantage, HeartSine and Certol. Medsav Solutions has not altered, revised, changed or implemented anything different from each manufacturer product warranty.

52.212-4(0) Warranty

SJ Medsav Solutions LLC warrants and implies that the products delivered hereunder are merchantable and fit for use for the particular purpose and will be free from defect in material and workmanship described in this contract up to and upon product title and physical title possession is accepted by the government at the time of delivery.

52.212-4(p) Limitation of Liability

Except as otherwise provided by an express warranty, SJ Medsav Solutions LLC will not be liable to the Government in a breach of warranty action for consequential damages resulting from any defect, misuse of the product, neglected, modified, altered, adjusted, tampered with or deficiencies in accepted items.

·  Pro Advantage Medical and Dental Furniture and Accessories: 3 year limited warranty. Products backed by this warranty are warranted against defects in workmanship for 3 years from date of purchase. This warranty does not include electrical products.

·  Pro Advantage Sprague Stethoscope: 5 Year Warranty

·  Pro Advantage Nurse, Dual Head, Bowles, Pediatric, Infant Stethoscope: 1 Year Warranty

·  Pro Advantage Deluxe Aneroid Sphygmomanometer & Premium Pocket Aneroid Sphygmomanometer: Lifetime calibration warranty, 2 year system warranty

·  Pro Advantage Standard Pocket Aneroid Sphygmomanometer: 10 year calibration warranty, 1 year system warranty

·  Pro Advantage Sphygmomanometer Accessories: 2 year warranty

·  Pro Advantage Urine Analyzer: 1 Year Warranty

MEDSAV SOLUTIONS CERTOL PRODUCTS WARRANTY

SJ Medsav Solutions LLC, hereby warrants all parts and equipment that come in contact with Certol Products that are used during normal usage and that become damaged, which upon examination by Certol International, LLC and/or designated and qualified repair service, is determined to be caused by contact with Certol Products. SJ Medsav Solutions LLC’s obligation is limited to repairing or replacing any component and/or parts which upon our examination is determined to be damaged by Certol Products.

This warranty is in lieu of all other warranties, expressed or implied. This warranty shall not apply to defects resulting from accidents, alteration or misuse of Certol Products. If, in the opinion of Certol International, LLC’s engineers or designated expert, modifications, changes or repairs have affected the operation of components, parts or equipment in general so as to render it faulty, this warranty shall be null and void.

SJ MEDSAV SOLUTIONS LLC DOES NOT WARRANT THAT CERTOL

PRODUCTS ARE MERCHANTABLE OR FIT FOR ANY

PARTICULAR PURPOSE OTHER THAN THOSE DESCRIBED ON THE LABEL.

THERE ARE NO EXPRESS OR IMPLIED WARRANTIES MADE BY

SJ MEDSAV SOLUTIONS LLC EXCEPT AS EXPRESSLY STATED IN THIS

WARRANTY OR AS STATED ON THE PRODUCT LABEL WHICH

ACCOMPANIES THE PRODUCT AT THE TIME OF PURCHASE.

MEDSAV SOLUTIONS SAMARITAN EXTENDED LIMITED PRODUCTS WARRANTY

What is covered? We provide to the original end user a limited warranty that all HeartSine® samaritan® products that are purchased for use in the United States from Medsav Solutions authorized by HeartSine Technologies, Inc. (“Authorized Agents”) are substantially free from defects in material and workmanship. This limited warranty applies only to the original end user and may not be assigned or transferred. An original end user is one who is able to provide proof of purchase from HeartSine or Medsav Solutions. Persons who are not original end users take the products "as is" and with all faults. If you did not purchase this product directly from HeartSine, please be prepared to provide proof of purchase demonstrating that you are the original end user and eligible to make a valid claim under this warranty. If you are not sure that Medsav Solutions from whom you purchased any HeartSine® samaritan® products is authorized by HeartSine Technologies, Inc. please contact Customer Support on +1 215 860 8100 or

For how long? Medsav Solutions warrant the samaritan® PAD for a period of ten (10) years and the samaritan® PAD Trainer for a period of two (2) years from the date of the sale to the original end user. Products with a stated expiration date are warranted until such expiration date.

What this limited warranty does not cover: This limited warranty does not cover defects or damages of any sort resulting from, but not limited to, accidents, damage while in transit to our service location, alterations, unauthorized service, unauthorized product case opening, failure to follow instructions, improper use, improper or inadequate maintenance, abuse, neglect, fire, flood, war or acts of God. We do not warrant your samaritan® product to be compatible with any other medical device.

This limited warranty is void if: You purchased any HeartSine® samaritan® products from anyone other than an Authorized Agent; your samaritan® product is serviced or repaired by anyone other than HeartSine Technologies, Inc.; Your samaritan® product case is opened by unauthorized personnel or if a product is not used in accordance with the Instructions for Use and the Indications for Use provided with your product; Your samaritan® product is used in conjunction with incompatible parts or accessories, including, but not limited to batteries. Parts and accessories are not compatible if they are not samaritan® products or the functional equivalent.

What you must do: To qualify for this limited warranty, you, as the original end user must send the completed Warranty Validation Card within 30 days of original purchase to HeartSine Technologies, Inc. 121 Friends Lane, Newtown, PA 18940 or register online using the Warranty Registration link on our website www.heartsine.com. To obtain warranty service for your samaritan® product, contact your local HeartSine Authorized Agent or call us toll free at 1.866.HRT.SINE. Our technical representative will try to resolve your issue over the phone. If necessary, and at our sole discretion, we will arrange for service or a replacement of your samaritan® product. You must not send back any product without our authorization.

What we will do: If your samaritan® product contains defects in material or workmanship and it is returned, at the direction of a technical service representative, within the warranty period, we, at our sole discretion, will repair your product or replace it with a new or reconditioned product of the same or similar design. The repaired or reconditioned product will be warranted subject to the terms and conditions of this limited warranty for either (a) 90 days or (b) the remainder of the original warranty period, whichever is longer, provided the warranty applies and the warranty period has not expired.

If our inspection does not detect any defects in material or workmanship of your samaritan® product, regular service charges will apply.

Returned Goods Policy:

Government Return Policy

Return Policy: Medsav Solutions offers a 30-day return policy on most products. All returns must be in original factory packaging and undamaged. All parts and manuals must be returned. No returns will be accepted after 30 days.

RA (Return Authorization): An RA number is required on all returns. Call Medsav for an RA number and instructions on how and where to return your order. Customers should provide invoice number and PO. All returns without an RA number are subject to our 30 day return policy and may not be honored.

·  All packaging must be returned

·  Manufacturer's product packaging must be in reusable shape with no marking or stickers applied.
