Background

UNDP has had a long-standing commitment to support Libya in its efforts to strengthen institutions capable of delivering services and responding to the needs of the population. Since the start of the transition, UNDP has supported national efforts at reform working with multiple sectors and partners to realize the objective of successful transition and sustainable human development.

The EU funded UNDP project ‘Strengthening Local capacities for Resilience and Recovery’ is a three-year initiative aiming at supporting local authorities in Libya to respond to the many conflict and human mobility induced challenges - by strengthening the local resilience and recovery mechanisms - that impact negatively citizens’ access to essential services, sources of livelihoods, the social cohesion and security of communities. UNDP works in key communities on the migration routes – from Sabha and Murzuq, to Kufra, and Sabratha, not least Benghazi and Tripoli - engaging local municipalities, identifying entry points to integrate key community members, enhancing local stability and community security, advancing municipality socio-economic development and providing income generation opportunities for communities, and especially young people. With adequate support, municipalities in Libya can better plan, lead and coordinate efforts at achieving progress where people need it most - services, social cohesion and security, economic livelihoods.

Specific Context

According to the 2016 Humanitarian Response Plan, as of end 2015 there were 471,431 people of concern in Libya, including some 435,000 internally displaced people (IDPs) and 36,400 refugees and asylum-seekers presently registered with UNHCR (out of an estimated total of 100,000 refugees and asylum-seekers). UNCHR data for 2017, include an increased number of 538,435 people of concern, presenting rapidlyincreasing humanitarian needs and putting pressure on public services, livelihoods and social cohesion in host communities. Furthermore, the conflict has triggered an acute deterioration in the country’s human rights situation with reported indiscriminate shelling of civilian areas, the abduction of civilians, torture and reports of executions, as well as deliberate destruction of property, among other serious abuses and violations of international law in various parts of the country. Women, children, minorities, IDPs, migrants and refugees suffer disproportionately form the violence and insecurity permeating every aspect of their lives.

In the most affected areas, the delivery of basic social services is disrupted and the capacity of state institutions to maintain a safety net diminished. The conflict impacts service delivery systems in various ways: direct damage to infrastructure, attrition of staff and other staff-related issues (e.g. late payment of salaries), increased financial costs involved with operations and maintenance, breakdown in the institutional oversight and coordination, and more. These direct and indirect impacts exacerbate pre-conflict deficiencies that affected all public services in Libya across the board, and especially in the South.

In this regard, UNDP is seeking to hire an international consultant to provide substantive guidance and support to the team working on the project. Under the direct supervision of the Project Manager, the consultant will be responsible to carry out the tasks outlined below.

Duties and Responsibilities

The overall objective of the consultancy willbe to increase the understanding on the processes and regulations for the registration of migrants in Libya, as well as their registration as foreign workers (in particular in the construction and services sector).

The consultancy will respond to the following questions, helping increase the understanding on:

  • The legal system for migrant registration (refugee / IDPs) – where, who, how
  • How the system is applied locally
  • How information is collected and used and who is responsible
  • What process in place for hiring workers
  • How companies interact with process
  • Different ways in which process works in different geographic locations (and why any differences)
  • What bottlenecks exist in the system and what could be done to overcome those (both quick wins and more systemic changes required).

It will aim to identify potential ways of linking economic development with vocation education

  • What are the entry points to enhance job placement for migrant workers (if additional training is needed, what solutions could be provided)
  • What incentives or requirements could be put in place
  • How to establish/ connect facilities at the municipality level to help with the job placement for migrants
  • How should this be communicated
  • How to manage community / armed group / criminal interests

The tasks performed under this assignment include:

  1. Undertake a brief assessment /desk review of the current situation of migrants’ registration;
  2. Conduct meetings with the key stakeholders in Libya (national and local institutions, migrants) and in Tunis (development community) in order to understand the current situation and the existing potential for development – to support the recruitment of migrants under works performed by the project
  3. Identify areas with highest potential and promise in terms of development impact
  4. Draft analytical report on the findings of the mission, provide key conclusions and recommendations, with a focus on the immediate needs, entry points, as well as more comprehensive intervention.
  5. Present findings to interested key stakeholders

Skills required:

  • Universitydegree (Master Degree) in political science, sociology, economics, law or related field.
  • At least 7years’ experience in the areas of post-conflict local development
  • Extensive understanding of the issues related to migration, conflict and development
  • Experience in working in crisis region with focus on migration and development, reintegration of migrants, local and economic development
  • Experience of working in the Arab region is desirable.
  • Fluency in English is required; fluency in Arabic desirable.

  • Excellent analytical judgment and demonstrated ability to handle confidential and politically sensitive issues in a responsible and mature manner.
