TOWN OF LYERLY

AN ORDINANCE OF THE TOWN OF LYERLY TO AMEND WATER AND SEWER RATES FOR ALL CUSTOMERS.

WHEREAS, it has been the long and well established practice and policy of the Town of Lyerly that its water system and sewer system be financially self-sustaining; and

WHEREAS, the town has become concerned with the decrease in water revenues and similarly concerned with the revenues generated by the sewer system; and

WHEREAS, the town has reviewed the water and sewer rates charged to all customers; and

WHEREAS, upon the review of the rates and the present budget deficit the town declares water and sewer rates need to be increased in order for the water and sewer system to be financially sustained.

NOW, THEREFORE, BE IT ORDAINED, BY THE MAYOR AND COUNCIL OF THE TOWN OF LYERLY, COUNTY OF CHATTOOGA, AS FOLLOWS:

Section 1. Water Rates

Water rates for Town of Lyerly customers shall be set by the Mayor and Council. Rates will be charged according to the following schedules:

Section 2. Classification of Water Customers

Residential- Residential customers shall be classified as connections for which water’s predominant use is housing, and includes but is not limited to: single family housing, or multiple family housing (apartments, duplexes, town homes, condominiums) holding separate meters for each individual unit.

Commercial- Commercial customers shall be classified as any building with more than 50% of its floor space being used for commercial/business activities. Commercial buildings include but are not limited to: stores, offices, schools, restaurants, gymnasiums, libraries, hospitals, clinics, warehouses, jails and government buildings. Residential connections in which one meter supplies more than one household will be charged commercial rates. Connections for agricultural/farm use shall fall under this category.

Industrial- Industrial water users are classified as any water user in which ten or more percent of water consumption is used in the manufacturing process or any customer with meter size of 4” or greater.

Section 3. Irrigation

Irrigation rate is charged at $7.00 per thousand gallons used, with no minimum charge. Irrigation rate is exempt from sewer charges. In order to qualify for irrigation rate, the customer must have their irrigation system separately and properly metered with a backflow prevention device. The meter, which will be specified by the Town, or will be provided by the Town for a fee, must be installed with operating gate valves on each side with a backflow prevention device upstream of the meter.

Section 4. Fire Protection

The fire protection water rate shall be $54.00 per month. Use of water from fire service lines and fire protection systems for any purpose other than fire prevention is prohibited.

Section 5. Sewer Rates

Sewer rates are set by the Mayor and Council, along with USDA Rural Development. Rates are charged according to the following schedule:

Section 6. Classification of Sewer Customers

Residential- Residential customers shall be classified as connections for which sewer’s predominant use is housing, and includes but is not limited to: single family housing, or multiple family housing (apartments, duplexes, town homes, condominiums) holding separate meters for each individual unit.

Section 7. Credits

Credits to water and sewer accounts will be issued on a one-time basis, to equal to no more than $100.00, and is at the discretion of the Utilities Supervisor and Mayor. No credits will be issued to any customer at any time for water used to fill swimming pools, water slides, or irrigation purposes. Leaks found on the customer’s side of meter is solely the responsibility of the customer and no credits will be issued.

Section 8. Additional Water Purchase

No water will be sold in bulk unless metered under the supervision of the Town of Lyerly. Water sold in bulk will be billed at the most recent irrigation rate. Accessing water outside of these conditions is theft of services, and punishable as such. Access to fire hydrants on Town of Lyerly Water System is restricted to fire and water department personnel only.

Section 9. Applicability.

The effective date of this ordinance is June 28, 2011.
