Case File Activity – Discussion Questions

Instructions –You are the Prosecutor in the case against Brenna. As you can see, she has committed various crimes over the course of the date in question (November 25, 2016.) As the Prosecutor, you have to decide with which crimes you will charge Brenna, as well as determine your likelihood of success on the charges. Use the information in the case file to answer the following questions.

PART I – Bringing the Charges

Begin by reading through the case file. Remember, each document only gives a portion of the information needed. You need to look at all of the documents in order to get a clear picture of what happened.

List all of the crimes with which you will charge Brenna (Hint – use the ones we talked about in class. Don’t worry about defenses yet.) You should be able to find at least 5. Focus only on crimes that we discussed in class.

Once you have identified the crimes, check in with the lead prosecutor (DA Hollis) and make sure you have the charges correct. Once you’ve solidified your charges, move on to Part II.

PART II – Assessing Your Chances for Success

Now that you’ve identified the charges that you’re going to bring against the defendant, Brenna, you need to prepare for your case. Assess your likelihood for success on each charge. Make sure you identify the evidence that will help your cause (facts that meet the elements of the crime) and the evidence that goes against your case (such as missing elements and defenses.)
